We have been paying a credit card back at a reduced amount even though the statements ,for at least a year, said nothing was due.

 

 

Then last November we received a statement saying nothing was due due to a write off debt sale

 

Now I find that they had defaulted the account on that date

 

 

We received no correspondence about this,

 

 

Can they do this?

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

The company is Barclay partner finance

 

 

the loan was originally through Clydesdale financial services as part of a timeshare purchase (thats another story)

 

We could not afford the high payments

 

 

reduced them In January 2013

 

 

the statements stated no payment was due but we still kept paying

 

 

then in the statement for september 2014 it says total balance nil Write off sale debt

 

Then this week we were checking our credit references and it says in November 2014 they defaulted the account

 

 

We have had no correspondence or calls from them

 

 

We have been working hard to improve our score and this has knocked us back

 

 

but we had no warning so we could try and make it right

 

 

What rights if any do we have?

you said it was a credit card

not a rip off timeshare loan

 

 

got all the statements.

 

 

sounds like they've defaulted you and sold it on.

 

 

9/10 there is always something very wrong with timeshare loans.
