My question there is really what might constitute proof? Since you say the issue of delivery is a common one I suppose that no satisfactory answer has been established or you would probably have told me.
    • I would stand your ground and go for the interest. Even if the interest is not awarded you will get the judgement and the worst that might happen is that you won't get your claim fee.  However, it is almost inevitable that you will get the interest.  It is correct that it is at the discretion of the judge but the discretion is almost always exercised in favour of the claimant in these cases.  I think you should stand your ground and don't give even the slightest penny away Another judgement against them on this issue would be very bad for them and they would be really stupid to risk it but if they did, it would cost them far more than the interest they are trying to save which they will most likely have to pay anyway
    • Yep, true to form, they are happy to just save a couple of quid... They invariably lose in court, so to them, that's a win. 😅
    • Your concern regarding the 14 days delivery is a common one. Not been on the forum that long, but I don't think the following thought has ever been challenged. My view is that they should have proof of when it was posted, not when they "issued", or printed it. Of course, they would never show any proof of postage, unless it went to court. Private parking companies are simply after money, and will just keep sending ever more threatening letters to intimidate you into paying up. It's not been mentioned yet, but DO NOT APPEAL! You could inadvertently give up useful legal protection and they will refuse any appeal, because they're just after the cash...  
    • The sign says "Parking conditions apply 24/7". Mind you, that's after a huge wall of text. The whole thing is massively confusing.  Goodness knows what you're meant to do if you spend only a fiver in Iceland or you stay a few minutes over the hour there.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Here is a list of all phase II Universal Credit (UC) rollouts please see my attachments these are the areas that will be affected throughout 2015-16 please read the attachments to find out if and when you may be affected .... This will be from now until spring 2016

 

 

As most of you know UC means you only get paid once a month, you also get paid your HB as well. You will be responsible for paying this bills on time and making sure you remain in CREDIT with your rent as per T&C's of your tenancy agreements. (May vary between different Councils/Districts)

 

 

Failure to pay your Council Tax on time WILL/MAY see a Liability Order (LO) issued against you in Court. If this happens you will face the prospect of losing personal property and paying huge fees. Please read some of the threads here

does anyone know as the uc credit is being paid monthly if the monthly payment will take into account a 31 day month ? if not folks could be in for a shortfall ove 12 months.

 

I would expect the yearly benefit would be calculated then divided by 12 months. So some months better off than others

Edit - does anyone know when this will affect existing claims for Esa for eg

Council Tax is not included in Universal Payments, to get Council Tax reduction you will have to complete a separate application to your local Council.

 

If you are not a pensioner then (depending on your Council) you may be liable for some of the Council Tax regardless if you are on Benefits.

The system is currently only set up to handle single persons who would normally claim JSA. Had a quick scan of some of the documents mikeymack2002 posted links for. The one attached, lists most of the excluded:
mr p you are correct as it does state single persons only claims at this point. as im coming up to 62 im hoping by the time my esa is up for renewal ill be retired and maybe have some peace away from all this mess. will things ever get any better im wondering.

Will this affect my benefit at this time, will I be reassessed for UC and will it change the amount of support I get. I do not get housing benefit etc as I live with family. Feeling very confused right now.

I think a lot of folks are feeling confused matey but as I understand they are not looking at esa cliaments at this time only single person claiments and that may only be new claiments not sure. if you have been claiming esa for over 2 years I think you are assessed every 3 years. ive just been granted esa support group for 3 years first time ive ever applied for it. maybe you will change o assessement don't know. if you are worried call the dwp esa line which I found helped me a lot. whenever I called them got a straight helpfull response and then you would get info straight from the horses mouth so to speak.

According to this then - if you are a home owner you are NOT eligible, or am I reading it wrong.

Not all home owners have mortgages. If you are homeless or in temporary accommodation you also do not qualify. Reading between the lines, Universal Credit is being rolled out for anyone in rented accommodation with much more to lose if they are sanctioned. Call me cynical, but it looks very much like a twenty-first century version of the Highland clearances of the 18th & 19th centuries.

I have found written evidence from the DWP that UC does pay mortgage interest (SMI) but there is a wait of 12 weeks, which I think is the same as the old system.

Universal credit is paid monthly (not four weekly) in arrears. Possibility of bi-monthly payments for claimants who find it difficult to budget.

 

Rates of universal credit may vary from month to month dependent on how much (if any) work has been done during the payment period.

 

No signs yet that I'm aware of; from claimants, contributors to CAG, or Work n Pensions ministers that claimants of income related employment n support are being asked to claim universal credit. When there are, initially it'll probably just be new claimants and ones with changed circumstances. Anyone with more up to date info, please share.

 

There's two rates of the limited capability for work element, paid in addition to the standard allowance. Currently the higher rate of £311.86 per month appears to replace the enhanced disability and severe disability premiums.

 

As with the change from incapacity benefit to employment n support, there'll be transitional protection for claimants who'd otherwise get less universal credit than they received from their previous benefits. Transitional protection lasts until it's eroded by inflation or ended by a change of circumstances.

 

The housing costs element can be used for mortgage interest (eventually) or rent. For the moment Government's decided not to include the intricacies of housing costs in universal credit for claimants in care homes and hostels. They'll continue to receive a separate payment of housing benefit from their Local Authority.

they are trying to implement for the "easiest" cases as DWP do not have resouces/processes in place to figure out how to deal with majority of clients

Yes, I remember reading somewhere it's now just for single people on JSA.

 

And to answer my own question - there's no SDP. Which begs another question - under LHA / HB, you can only get enough to cover the 1 bed rate if under 35 and receiving SDP. What happens there then? Doesn't affect me because I rent from housing association.

At the moment many JC's are actively assisting claimants that will be affected with weekly workshops, this will including budgeting and how to save money by shopping wisely.

 

 

Some of the course will show you how to cook tasty meals on a budget, I asked to go on this course just to see what is what, the information that was given was helpful and the hand-outs were of use especially the cooking side of things. If allowed I will post up the cooking on a budget form that was handed out if the site team will permit?

Hi Everyone,

 

I reside in the North West and I believe only the simplest of cases will apply. I myself have CTC+WTC+CB+HB+CTB. So in my case it is a lot more complex and existing claims will be migrated in a couple of years. I have read they don't have the

technology in place to deal with such case-think it was the fiscal studies body who wrote this.
