    • Hi guys, Wondering if you can help me. I received a claim form from County Court Business Centre, Northampton for Private parking fine I received back in June 2018. I wasn’t wise in responding to any letters to date hoping it will go away which is my bad hence landed on this site for help.   Here are all the info you may need:   Name of the Claimant – UK Car Park Management Claimants Solicitors – Gladstones Date of issue – 10/06/2019 (Deadlines - 29th June for AOS & 12th July for Defence) Particulars of claim: ‘The driver of the vehicle with registration xxxxxx (the vehicle) parked in breach of the terms of parking stipulated on the signage (the contract) at 93-101 GREENFIELD ROAD – LONDON GREATER LONDON E1 1EJ, on 11/06/2018 thus incurring the parking charge (the PCN). The driver of the vehicle agreed to pay the PCN with in 28 days of issue yet failed to do so. The claimant claims the unpaid PCN from the defendant as the driver/keeper of the vehicle. Despite demands being made, the defendant has failed to settle their outstanding liability THE CLAIMANT CLAIMS £100 for the PCN, £60 contractual costs pursuant to the Contract and PCN terms and conditions, together with statutory interest of £11.69 pursuant to s69 of the County Court Act 1984 at 8.00% per annum, continuing at £0.4 per day.’ Value of the claim - £246.69 The claim has been issued by the Private parking Company Date of the infringement - 11/06/2018 Date on the NTK – 14/06/2018 They took two pictures of my car and printed them in the letter  As mentioned, I did not respond to any communications. I received, NTK, Formal Demand letter in July 18, two DRP letters on Aug 17 and one in Sept 18, and three Gladstones letter in Oct 18 and then ‘letter before claim’ in March and April 19.   I will do the AOS asap and send a SAR to UK CPM.   Please help me with a writing a defence, I have already read through many, but they are a bit overwhelming as I am not sure what my grounds are. I am sure the driver did not agree to pay anything as they have stated in the particulars of the claim. This was a Camera PCN so whoever was driving the car would have not known that they received a PCN. Also, I have visited the car park to see the signage and they are appalling. They are affixed high, with tiny fonts and the signages are blocked with bins and other materials so you can’t get close to it. There are no signage at the entrance of the car park.   I look forward to your response.   Thank you
    • Hi dx,   Latest info is:   "The court has received an Incidental Application from the respondant". That will be my letter from Cabot advising that they cannot legally proceed with the case. "The Sheriff has received an objection from the claiment to the Incidental Application".   I have now received notification that the sheriff has ordered the case to be restarted.    
    • you should have been reading up on charges reclaiming in the down time.     CISHEET enter every charge on the date it was levied put their avg int rate in D15.      
    • get your finger out. you must reply to the letter of claim as stated in every PAP letter thread here regarding drydens/erudio and old SLC stuff.   go ring slc and ask the date of your last deferment.   if they refuse, quote them the two acts prevention of fraud and  data protection act. that they MUST hold data for 6yrs under both and if they wont give the data you will be immediately phoning the ICO and raising a serious complaint against them. now if they don't hold the data, as its over 6yrs old i'd say its safe to say the debt is statute barred reply to drydens PAP as per the other threads here send our SB letter DO NOT USE THEIR REPLY PACK.   use our in our PAP thread.

mrst1982, no nothing from Wonga re my payment yet so I'd prepare for a bit of a wait. Went back to my adjudicator after the 2 days were up and she has contacted them again with the promise that if FOS would escalate if they have not actioned within 14 days. to keep the pressure up, I also contacted the FCA to let them know Wonga have not complied. AS my with complaint, Wonga have just blatantly ignored me when I contacted them asking about payment. The more people that lodge complaints the better as it costs them a case fee and hopefully put this rancid company out of business

Update...

 

I've recieved and declined an offer today. Wonga contacted my adjudicator and in turn she has informed me that they would like to offer to refund the interest and fees on 7 off my loans (7 out of 39!) Goodness knows why those ones. Nearly a grand for those 7 alone. THE CATCH.... They want to deduct from that what they have already written off in November and pay me just over £119. My adjudicator had originally told them to refund interest and charges from all loans which they ignored. And so the wait continues for an ombudsman to review and make a decision which either way is binding so here goes nothing......

This is why I am going to take their £50 as I haven't got the time nor energy to keep up a fight with them, took them long enough to come to the £50 conclusion.

I had 37 loands with PDUK, 11 with PDE, 11 with Wonga and already sorted the QQ and P2P ones so I say hold in there. So far QQ, P2P and 247 Moneybox have all written and cleared the debts and credit file updated. Am waiting on a response now from the big 3 which is £10k in interest and charges alone and not to mention had roughly 10 payday loans at one time every month for almost 2 years!! No way there was any responsible lending (or borrowing) I know but it was a dark and dire situation and one I'm working hard to fix! Saying that if I can get my credit file updated and any money back is a bonus! So 6 weeks to go and counting now! To be fair all 3 have responded to emails and calls as well as sending me the documents I've asked for all within the first week!

Any of my PDL debts are already statute barred so I don't have any worries over them marking my credit report. I am posting Wonga's acceptance letter of the £50 tonight so I should hopefully get their cheque by the end of next week.

 

I just do NOT trust them enough to give them my current bank details. I had enough problems with PDL companies attempting to 'help themselves' in the past.

 

I only had 2 or 3 loans with each company before I found this site and started dealing with the initial problem, ie DCAs sending pay up or else letters about debts which were very very suspect...once that was dealt with then I was back in the clear and didn't need to rob Peter to pay a lying Paul.

mrst, sorry for late reply.yes i received my money about 10 days ago - at least a fortnight over the 28 days they are supposed to have paid it - they added £50 for the addditional inconvenience! So kind of them :)

 

in my experience with the FOS, it would be very unlikely that Ombudsman would overturn the adjudicator especially when it is so clear cut in your favour - it also seems to move much quicker when you are not disputing the adjudicator decision - in two of my cases, there were decisions by the Ombudsman where I agreed with the adjudicator. In the other cases where I disagreed with the adjudicator, I am still waiting for the Ombudsman.

yes and they do send a standard response back but query it and then you should hear from the resolution team make sure your are formally complaining under affordability assessments etc and miselling based on long term borrowing so be clear the number of loans over what period etc plus ring the FOS and log your complaints they are so helpful and i have spent 4 days reviewing all the PDLs I have had and with PDUK for instance 36 consecutive loans in a 4 year period having borrowed £22500 all paid back but prime example of miselling even PDUK were shocked (they are also under the same group of companies as Payday Express) just for PDUK alone £7000 if interest and charges but thankfully all paid back so I want a refund! Good luck and just be clear to yourself about what you are hoping is the end result so for me with QQ and P2P having the debt cleared was the end game but for PDUK the debt is clear but I want some of that money back to the extent I'm now challenging LlOyds over a loan I took out 12 years ago and still paying which is what started my whole financial spiral.

 

Received email from QQ today with an attachment claiming that they did the required affordability checks with CallCredit and mentioned consumer credit agreements from each loan. Any suggestions?

kevin_d, escalate to FOS - there is little work in filling out their complaint form and attaching a few bank statements. You have nothing to lose, it costs you the price of a stamp and each case with FOS costs Quickquid a sunstantial amount of money (around £500 per pop) - despite the FOS being a bit of a weird system people, ultimately by people formally logging complaints does change things

You were right. Ombudsman have been in touch and they agree 100% with my adjudicator therefore Wonga have been ordered to repay all interest and charges (as this is what I've ultimately wanted all along I have accepted the ombudsman final decision)

 

I just wondered what now?

 

Did wonga contact you with figures? Phone or write etc..? Or did a cheque just land on your doorstep one day. ?

 

I know they'll drag their feet about paying up... but it's just to give me some idea of what will happen.

the process with Wonga with me was that I signed and returned the settlement form which the FOS then send to Wonga.

 

 

A contact from Wonga emailed the same day asking to confirm bank details for payment then it all went quiet!

 

 

They are supposed to make payment within 28 days - if they dont, you can then contact the adjudicator again and they will chase them up.

 

 

It took about 7 weeks all-in for me to get funds - mines was only a partial refund so it was easy to calculate.

 

 

I would advise you to go through your bank statements and then apply the 8% simple interest

(if you search on google you will be able to get a simple calculator tool to help you with this

or I think there may be something on here somewhere)

 

 

Did you get credit file entries removed as well?I

 

 

've just been informed my refund from Uncle buck is on its way today as well

- it is a particularly nice feeling given the heartache these companies have caused

My refund from Wonga arrived yesterday, just the £50 as they claim they wrote the alleged debt off...despite the fact that I was one of the people who rumbled their dodgy solicitors letters - they forced me to take a good hard look at the paperwork I was getting for alleged debts and managed to get rid of 11 debts in 7 months, when had I stayed in a DMP I would still be paying now!

 

Their sins found them out - and now they are looking at rebranding and maybe changing their name. They are also looking at getting into longer term loans - seems to be a big rise in companies dealing in 'guarantor' loans, maybe the next toxic debt area?

Great news acid53 congratulations. Yes I agree definately a nice feeling after several years of dealing with them. Finally it's nearly over. Phew x

 

Yes they have been told to remove credit file entries and they have also been told NOT to deduct from my redress the amount that was written off in November.

 

Did they provide you with a breakdown of your refund at all? To compare to your records etc...

I would advise anyone to stay clear of these Guarantor loans - especially if you are being asked to be the Guarantor !!

Yeah it's gonna be a bit difficult to work out. There will be about 33/34 loans and/or top ups over a 18 month period plus 8% interest.

 

I am in a better place now so thankfully was in no rush to win this but I was definately gonna fight them for what they do to people and how they take advantage. Things need to change.!!

 

No others thankfully x

 

The only other thing I have ongoing is a complaint with my bank for a packaged bank account that is only on its beginning stages tho.

Well I spoke too soon! Just had the adjudicator on the phone and wonga have finally made me an offer of £2666.62! Im over the moon. Ive accepted and got to wait the 28days to get the funds.

 

I urge anyone to try and claim back what they are owed as it costs nothing. I got a flat 'no' to my complaint to Wonga. If I had accepted it I would be £2666.62 worse off.

 

Fresh start now as that clears all my outstanding debts and leaves a little. Im still pursuing Quickquid.

Just shows you should never give up just because they say no. I am just waiting for Lending Stream who are giving me the runaround. Then I'm done with these sharks forever.

well done guys - given the scale of these payouts, I really wonder how long some of these companies will be able to survive, if you take even a couple of thousand people having complaints upheld at a few grand each it is some serious money especially for the smaller ones. they are really getting their cumuppence which is almost as sweet as the money (well, not quite :) )

Well said acid. I was living in fear of these companies for so many years taking out more loans to keep them happy. The day I decided no more was a real turning point.

 

I e-mailed Lending Stream at the beginning of Feb. Didn't hear anything then they e-mailed me and asked I I had received their e-mail at end of Feb (which I hadn't). They basically said they hadn't done anything wrong and rejected my claim. I e-mailed them back and said I didn't agree and if that was their final response I would take it to Fos. They replied and said they would look into it further. 2 weeks later they replied and said they had done the correct checks and my credit score was good when I applied for the many loans I had but offered me £75!!! I had paid over £2000 in interest. I e-mailed back and said no thanks will take it to Fos. I pointed out my credit score was trashed due to the number of payday loans I have had and had in fact defaulted on most of them. They have now asked for a screen shot of my credit report which I sent a week ago. They have til the end if this week then I will send it to Fos. Just think they are messing me about now.

thanks jec - ive got about 10k back so far which has done wonders for my life and allowed to start really reducing the cycle of debt ive been in. the only thing that has slightly annoyed me is that the ombudsman has not confirmed removal of credit file entries on a number of complaints. If I could get all these buggers off my credit file, i would be in a much better place but the fos is a weird system

 

I have had similar response from Lending Stream just last week in that they did all proper checks etc (though I have yet to meet or hear from one lender who actually admits to doing anything wrong etc. they were one of the last lenders in the cycle I was in (i had already lent from most of them and no one else would touch me). They did actually tidy up some credit file entries when i complained before so i dont believe they the worst of the lenders (minicredit, uncle buck and wonga were my worst experiences). I am weighing up what to do with them as i would actually prefer them to delete my credit file entries rather than refund any money

 

How did you get on with your credit file entries?

Update- ombudsman have contacted me again today. Wonga have failed to respond to their request so they are escalating it to the formal process. I have also started the process with quickquid. They responded within 6 hrs to my formal complaint with a final response stating they dont feel they lent irresponsibly so declined my request for a refund of interest. I sent this to the ombudsman and its been passed to the guy who is dealing with my wonga complaint. He feels I have a good case although not as clear as wonga so its just a case of waiting to see what happens.

 

Just an update on the Quickquid complaint. Ombudsman have suggested that I am unable to proceed this complaint as I am unable to include my other PDLs in my income and

Expenditure. So even though I had multiple other PDL's they said that Quickquid could not have been expected to know that when issuing a loan. It would appear to them that I was able to afford this loan as they dont account for other PDL when looking if you can afford the repayments. Sounds daft to me but im happy with my wonga result so going to draw a line under it now.

I've been looking through a lot if decisions and there seems to be a real difference of opinion and how things are dealt with based upon your adjudicator. I've had a very good one on my three cases and I've always been very prompt and complete in responding to any of his questions and it's worked out very well. Only one decision went to the full ombudsman which is provisionally in my favour so fingers crossed.

 

Anyhoo one of them was with wonga, i accepted their offer last Friday, they emailed me yesterday, I responded immediately and the money was in my account today. It was over a grand so a nice quick turnaround as a data point for you all...

kat2015 - thats a surprise they cannot include your other PDL's - i have a complaint against quickquid as well so interested in more info u might have on the complaint against quickquid. I know quickquid were one of the lenders who did more credit checks than the others but very few PDl's were actually recording info on credit files in the 2009/10 era when my complaint was (including quick quid themselves). That is a bit of a con as it allows companies like quickquid to say they did a credit search but when they did not record anything themselves then how could other lenders be aware of other pdls! Did you have many rollovers with quickquid?

 

 

heropanda - i couldnt agree more with you re FOS - it depends on the adjudicator. I know they are supposed to look at each case on its individual merits but in most of my complaints my circumstances were identical just with a different lender and I have a variety of outcomes. Most in my favour but differing with regard to amounts and credit file entries. I believe some of it also depends on how much "goodwill" the company shows
