      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all

I signed my girlfriend up to Noddle a few months back to check her credit rating.

 

She had previously explained that she found a letter from a company a year ago and her mum admitted to taking out the account without her permission.

They both phoned the company and they agreed a payment plan

and that they would send letters to move the account into her mums name.

 

They sent the signed letters back to the company and assumed it had been sorted.

Unfortunately the company didn't transfer the account to her mums name and it was still in her name.

 

We immediately spoke to her mum who agreed to pay the final amount,

we also reported this to the police and spoke to the company who have agreed to remove this from the credit file.

 

There is also a second entry for a defaulted account in 2010.

My girlfriends mum denies she has anything to do with this but the company has read out call logs that prove it is her.

She talks about missing payment due to a specific health condition that we know she has.

 

we now want to try and get this removed from my girlfriends credit file but we have hit a stumbling block.

 

First of all we reported it to the police and

spoke to the company and

they refused to remove it due to it being a civil issue.

 

We have also signed up to Equifax and reported it through them and received the same response.

 

The default is now paid but we want to try and correct the credit file entry.

 

My girlfriends mum has previous doing this sort of thing and is currently giving £170 a month to her other daughter

for a loan she fraudulently took out in her name.

 

This has been a tough decision to get the police involved but ultimately it has to stop and we don't want this to affect our future.

 

My girlfriend currently lives with her mum, who is terminally ill, and although moving out is the best option

she is keen to stay in the house to help her mum & dad through this illness.

 

Due to her getting a lot worse in the last few months we are confident there won't be any further cases

but we will be keeping an eye on her credit file to ensure so.

 

Do you think we can get this entry removed and if so what is the best course of action?

who is the company and what is the account?

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I don't have the written call logs. I'll get these sent off tomorrow! Once I get the data from the SAR what are my next steps?

 

The company is Lowell which I believe used to be Marshal Ward/Isme

aha - ISME/Marshall ward. owned by Redcats now brought out by a French company brand - La Redoute

 

 

not one we often see on here

 

 

makes me wonder why they've sold it to lowlifes

 

 

ge the sar done to them

 

 

when you have written proof of the illness etc

 

 

then I'd be posting that to the CRA people

 

 

it proves the data sent to them is false

and thus must be removed.

 

 

might drag a bit if that doesn't work.

 

 

but if you can prove that the data they hold is not based on the truth.

they should be removing the whole account.

I have just spoke to someone at Lowells as I wanted to get the account number for the SAR.

 

 

I also asked again how we remove this from the credit file and

 

 

they have said the only way to do that would be to refund the default amount that has already been paid

and then go down the fraud route which will take months and months.

 

 

So because there is no money owed on the account now they can't deal with it as fraud?!

 

They also pointed out the account will be removed from my girlfriends credit file in 18 months.

 

 

We ideally don't want to wait 18 months for this to go away

 

 

so will be posting the SAR tomorrow.

 

 

Are we OK putting a £10 note in the SAR request?

Lowell's will not care. They just want the money.

 

You also need to stay off the phone and stop paying. Even if your mum took it out you should not pay or arrange to pay. You need to challenge it. Lowell's will not change the account info. As said they simply do not care.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Just to be clear the account has been fully payed off. There is no money owed. We just want to remove this from my girlfriends credit file.

 

Lowells have now recommended they give us the money back that has been paid so it can be treated as fraud. Even though my girlfriend hasn't paid a penny to them

 

I now have the account number and will be sending off the SAR tomorrow

The SAR goes to the Original Creditor "La Redoute" and not Lowells.

I have only spoken to Lowells so far and they seem to have quite a few notes. Do I log a SAR with Lowells, La Redoute, Marshall Ward or ISME? I can only find addresses in the register for Lowells and ISME

SAR to the Original Creditor.

 

If your GF's mum spoke to ISME/Marshall Ward about he condition then Lowells will not have any of these screen notes.

 

Lowell's will only hold limited data, i.e. Name, Address, D.o.B. plus notes that you phoned in etc.
