      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, Ill make this short and sweet but I had my 'MEDICAL' assessment yesterday at ATOS and im so shocked with what it was like. I suffer from mental health issues and have been in the throws of this for around 10 years and have just been granted ESA to support me alongside my long awaited therapy which will last 12 months plus.

 

 

I was asked to attend an assessment and did so and was abs nervous etc about going but I did and went through what i can only describe as an interrogation. In all my years under mental health care I have never been second guessed about my symptoms, made to talk about why i am ill (this has to be done delicately for someone with my condition), had my answers questioned on my feelings and when I tried to describe my emotions (again not wise for someone like me) I asked for reassurance if she understood and her answer was 'kind of'. Even in my therapy or during going through the system under mental health care have i ever been probed and questioned and worn out by this interrogation style, almost made to feel like a criminal in some ways.

 

 

I dont think I was heard....how can I condense 10 years into 45 mins anyway?

All this and they expect YOU to get evidence aswell??

 

 

The reason I am posting this is because i cannot see someone with a worse condition than myself coping with this atall...it has left me very anxious and low but i have a good support network others DONT.

How can I effectively complain about this so it stops?? should I write to my local MP?

Dear Pealady thank you for your advice, having received knee injuries during my time in the army and suffering from PTSD from gunshot wounds to the head, I understand how you feel as I have had this condition for 35 years as when applying for a war pensionI found myself in the same situation with two medical assessments by so-called doctors for eachof my injuries, so I am aware of how they treat people.

I now find myself in a situation due to PSTD on long-term sick from my employee as I am, government officer I have now had to complete a medical questionnaire in order to receive ESA benefit as I am currently on half salary and then zero salary as from July, so I'm assuming that I will be asked to attend an assessment, even though my condition is being dealt with by combat stress, it is probably the best bet that the ATOS Dr will confirm that I have earache and stop allowance.

It is comforting to know that only the only one out there? , As you say, ATOS have a bad reputation, if they can declare people dying with terminal cancer fit to work, two months before they die then the government seriously needs to get rid of this company.

I don't know how fair it is to blame ATOS themselves, I suppose they are working to parameters set by government. A lot comes down to the individual interviewers though. Several years ago my wife had an ATOS asssessment and "they" turned her down for benefit even though she , with mental issues, could obviously not work. The interviewer that time was quite brusque. She had another assessment in January and it could not have been more different. This time the interviewer had much more empathy and my wife has full rate DLA.
