It is important that when dealing with legal/government matters, that you check and recheck, what you are writing. I have noticed that errors have appeared in your previous posts, be they typo's or missed words, so I would again urge you to check what you are typing before submitting. When writing something of true import, I find it best to compose in a Word document so as to be able to correct, add or delete as necessary, before 'copy and pasting' into the relevant box/form. I can understand that you are under pressure, stress, due to current personal situations, so it is even more important to pause, take time to check and allow your brain to regather its thoughts when composing important replies; as the person on the other end of the communication is not interested in your personal situation, just what you are writing in relation to the offences disclosed.

    • Hi all, I sent a copy of the court bundle to the 2 email addresses provided by JK and followed the instructions to change the hyphenated é to a normal e in the email address. This has worked as I have not received an undeliverable email saying that the email does not exist. As per my previous posts, a copy of the court bundle has also been sent by post to the court and to Evri.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I've got a outstanding Argos store card debt of less than £900.

I was signed off work before Christmas with anxiety etc and informed Argos/FRS and was asked to send sick note which I did.

 

My arrears at the time on the total debt were £150 and I've been paying £20 each & every month,

I know its approx. half of the minimum payment they want but it has been paid.

 

I asked argos to accept this amount but they wanted a detailed income etc form completed and I mean detailed, and didn't fill it out.

 

 

I'm in arrears with my electric which is a priority debt and they have been brilliant dealing with everything by email

as I'm finding it hard to talk on the phone at the moment. Yet this non priority debt isn't happy :-(

 

today I had a letter from Moorcroft saying I have 7 days (now 5 due to them posting it!) to contact them with payment

or a proposal for repaying if I can't afford the full amount.

 

 

I'm still paying each month and I've asked to pay in several letters & emails to argos yet its now with Moorcroft.

 

Some of the debt is £12 charges and interest etc.,

I will write to Moorcroft and offer the £20 I'm already paying but if Argos/FRS

didn't even reply to my offer why would Moorcroft accept?

 

Please can anyone advise me what to do, many thanks

SImple. CCA them. Dont send anything else. Keep paying argos for now ( Hope you CCA'd them too). If they cant give you a valid CCA response within 12+2 days, then you stop paying.

 

 

If moorcroft say they are acting on behalf of argos, then ignore moorcroft and get a FULL complaint going into argos. They should NOT be getting a silly DCA involved when you are already paying the debt off.

No haven't sent of a CCA, do I need to send one to Argos and one to moorcroft?

I asked them to stop interest on my account for 6 months while i get myself sorted but they said they couldn't and then sent me the income forms to fill out, I thought by sending the doctors note was enough. I emailed a complaint to Argos and they said if I didn't fill out the income forms they couldn't help me, they wanted to know everything. Maybe I should have filled them out?

If they will not stop interest and charges, then drop them to £1 a month. As for their income forms, ignore them. You supply a very simple budget summary. Nothing more. You certainly didnt need to send a doctors note for a stupid catalogue debt.

Argos and similar firms know that they are low on the priority list, so thats why they shout the loudest, they hope that you don't know this, and will treat them the same as Council Tax and electricity, etc

there are plenty of draft letters in the CAG library, I have linked the section for you above. Choose one and send it to Argos. Also send the CCA request.

 

I don't think a GP's certificate will be sufficient, however, if you have made them aware of the situation and are still refusing to help, then they will look very bad should it go any further.

and as a reciprocal GOGW they must freeze int & refrain from levying PENALTY charges.

drop them to £1PCM for life.

I know I need to pay argos, and not disputing this,

 

 

just asking to reduce the minimum payments until I sort myself out.

CCA is the valid credit agreement. If they cannot produce the original one plus all terms and conditions at inception and any changes, OR a valid reconstituted one, then they cant go to court, so theres no point you paying it.

 

Send the CCA request and see what they come back with. Regarding charges, that means you will need to send a SAR, and it will cost you £10.

had letter this morning from Moorcroft telling me that the last payment I made argos

should have been sent to them not argos and all future payment must be sent to them

and they are still waiting for me to tell them how I am going to repay,

 

 

I have 7 days to let them know.

 

 

I pay at the beginning of each month, so that payment to Argos would have made before getting letter from Moorcroft anyway.

 

Not heard anything else regarding the CCA request but they would only have got that on Monday.

 

 

Shall I just carry on paying Argos each month until I hear about the CCA?

No. You're right. The CCA goes to the company who is currently chasing you. A sar goes to the original creditor.
