Hi,

 

I received a Marston enforcement notice for a previous tenant (moved out 8 months ago).

 

 

I called them up (I have dealt with other bailiffs regarding this tenant)

and explained that he moved out 8 months.

 

they wanted proof that he had moved, ok so what do you need

- they couldn't (wouldn't?) answer the question and kept saying I needed to prove it.

 

 

How do you prove a negative?

 

 

they said they will send enforcement officers.

 

 

Do I really have to go through all this or is there a way to call them off?

 

 

The other problem is that I work away a lot and they could potential gain access without my knowledge eventually.

Give them a copy of your tenancy agreement and a copy of a council tax notice. Don't get angry with them yet. They have heard every trick in the book, and because they have a court order, they have to come there until there is proof the person isnt there. We've had a few situations exactly like yours on here lately. Each has the same answer. Provide the info and they will check, agree and refer the case back to the court and you wont hear from them again.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

They wont volujnteer as they have heard every excuse going. Just get the info i stated to prove he doesnt live there and send copies to marston. IIRC theres an admin on CAG that can help too as he has contacts within marston.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
