Ruthbridge Chasing Black Horse Debt

I have received a letter from Ruthbridge Ltd asking me to pay a sum of just over £9000 which relates to a loan taken out with Black Horse in 2007 for c£30,000.

 

Ruthbridge has supplied a copy of the CCA and a schedule of payments made on the debt right up to December 2012. The debt was originally defaulted on in 2008 and between 2008 and 2012 a nominal amount of £14 was paid monthly to the original creditor. At that point circumstances changed and that amount was not affordable.

 

However recently I got a loan for a car from Black Horse, and this may have triggered the system that I could pay back some of the original debt.

 

So two questions about the next stage really:-

 

1. The statement of payments sent by Ruthbridge from Black Horse shows a lump sum of £18000 paid off in 2008. I did not make that payment Should I ask Ruthbridge what that sum relates to?

 

2. I have no evidence of Ruthbridge now owning the debt. Should I ask for a deed of assignment from Black Horse to then (although I think the debt may have passed through other hands first)?

 

I have not yet acknowledged the debt to Ruthbridge.

No phone calls ...must be in writing

 

I have not yet acknowledged the debt to Ruthbridge. and dont all communication must be headed " I do not acknowledge any debt with your company "

You wont obtain a "deed" of assignment, only a Notice of Assignment. Was this debt secured on your home ?

 

IMHO, you need to send the original creditor a Subject Access Request, you should be able to work out from that where this huge donation to the account has come from.

Debt never acknowledged to them.

 

No loan is not secured against a house.

 

No payment protection insurance.

 

The huge donation was probably the goods bought with the loan being repossessed and sold, but that's for Ruthbridge to work out is it not? And then if it was the sale of the goods, do I then need to request all the paperwork relating to that sale?

Possibly but there is no requirement to disclose that unless Litigation has comenced

I think Ruthbridge will only administer the debt. Why not SA Blackhorse as mentioned.

Once you get everything back let us know.I wonder if that is just Blackhorse writing off the amount on their systems but with it still legally being owed.

I don't know, maybe it's just my head but it seems to me there's a load of pertinent info that your story is lacking. This has clearly been the subject of dispute for some time and you have already been communicating with Ruthlessbridge, eg you mention en passant [without explanation] CCA request to them.

 

You say you even obtained a car loan off Black H despite earlier significant default.

 

Is all this not indicative that Black H sold the first loan and the £18K is their accounting write-off?

 

I've never seen a Ruthbridge collection letter omit to mention on whose behalf they're writing. A case such as what you're describing would most likely be Cabot or possibly their bovver boys outfit Marlin.

 

But Cabot / Marlin always send a letter of assignment plus, for good measure, a second one pretending to be from the original creditor. You certain you didn't receive a notice of assignment from them or some other debt purchaser and certain that Ruthbridge don't refer to their "client"?

Ruthbridge wrote to me in December with the usual threats. That was the first I had heard from them. I emailed saying I did not know what the alleged debt related to. They said they would contact to get the original creditor and send me the details of the debt, which they have. There was no formal CCA request, but they've sent the CCA.

 

I think Black Horse repossessed the goods in 2008, sold them for £18k to set against the loan amount leaving £9k.

 

No I've not received a notice of assignment, just the original threats letter, and now the CCA photocopy with a letter asking me to ring them (which I'm obviously not going to do).
