Sighs and groans I'm sure from admins and members alike as this has no doubt been dragged up before, so sorry in advance if im treading over old ground :(

 

I signed up with my local guy "heights" in around october last year, this was after a year away in whihc apparently they changed to using Ashbourne to run their accounts.

 

At the time I had just left the army (was only in there just shy of a year) and had begun work in a local bank branch just around the corner so this worked like a charm, however after a month I was moved to a branch in the next town to us and a month after that my work load jumped as I was signed off to do more. This left going to the gym after work pretty much a no go anymore due to A) being drained by the end of the day (ill get my small violin :violin:) and B) By the time I get to said gym its at the point of rammed full (this is before the Jan rush)

 

Secondly to this money was needed elsewhere and like all people the first thing in my view to go was the gym, admitidly i did the wrong thing at this point and canceled my DD :-(

 

Ashbourne on the next payment missed gave me a call, I explained my situation saying it just wasnt working out anymore there and offered to pay the missed DD and call it quits its at this point I got the simple "no" reply :| alas I pleaded my case again and stated how it was unfair that I should now pay for a gym that I dont use, I was informed how gyms were a business and need to make money and this would damage them, I stated how I had paid a set up fee (because setting up a DD is a lot of expensive work) and the gym itself had made no outlay for me again "No"

 

This has gone on now for a number of weeks getting a call or two every other day and 2 letters a week, I have called back again and offered to pay a get out fee or admin fee and been told no the only way out is to pay the full sum.

 

Today I have been threatend to go to a debt collection agency which is worrying to say the least, along with a new amount owed of £124 keep in mind my membership is £37 a month which would run up to apparently owing for 3.3 months :???:

Now did I miss a letter on charges or something because that doesnt add up....

 

In short is there anything I can do? or is this just going to be a case of they have won by slapping me silly with spam and threating to throw me to debt collectors...:|

 

I understand its a contract but christ you would get less abuse for being late with a credit card payment or wanting to close credit cards or current accounts

Hi Easy and welcome to CAG

 

Don't worry for now about them adding admin fees (unlawful penalties) or passing it onto a DCA (who has neither power, nor authority). We will help you as far as poss. :wink:

 

Can you say, how far away from the first town was the gym, and then how far from the gym to the second town.

 

When you tried to use the gym after the work relocation, how long did you have to wait to use equipment.

 

And how did that compare to when you arrived earlier.

The town isn't a massive distance away but the trip time to the gym has gone from 5 mins to 30 to 40 mins. By the time the main crowd of after work people have got there and waiting for weights is the norm.

This is also coupled with being offered a better deal through work at a gym round the corner from my new work place.

 

It all adds up to make my current gym unsuitable when I have a better option I could change to. I was intending to cough up the cash today because I can't be dealing with there persistent calls and letters.

When they ring in the future, TELL them, ''Everything in writing'' & hang up, they'll soon get the message.

is exactly what they want, and exactly why they use this method of harassment.

 

The letters you receive are simply spat out and printed by their computers, they have no human input whatsoever, less for the posty pushing them through your door.

 

No-one at the company, knows at what stage their threatogramme cycle is at until you contact them and they bring it up

on their speak and spell computer.

 

Have you got the contract you signed with the gym?

Check the small print, and let us know what it says about cancelling membership, it may be that they have yet to comply with the OFT's guidelines (Now FCA)

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Hi Easy,

 

Because AMSL were the company who were first taken on by The OFT, their current contracts include clauses for cancelling due to redundancy, relocation, illness and injury. The OFT whipped them into line before focusing on the other major gym players.

 

If you pay AMSL what they are demanding now, that's your prerogative. But they'll still expect you to pay for the rest of the year's fees at £37 per month plus any late fees up to October 2015.

 

Is the 5 mins increasing to 40 mins by car, walking or by public transport.

Bazooka: Finding a copy of the contract might be a tough one any ideas if I can request a copy from the gym? The gym staff I know well its just ashbourne causing the issues

 

Slick: I thought I couldn't be charged any fees. More so if I have no been informed of those fees.

It's increase is from walking to one train station 15-20 mins a 5 min train trip and another 10 min walk. This depends on when trains are to boot.

Hi Easy,

 

They can add all the fees they like. However, just because the fees are mentioned in the T&C's does NOT make them lawful or enforceable at law. Same as Credit Card late fees which are not enforceable and reclaimable.

 

My advice would be to write to them :-

 

1. Confirming that you cancelled the DD due to work relocation, making the journey far longer; and the gym being too busy when you attended later after the longer journey.

 

2. Offering to pay one month's fee as you now realise you should have given a month's notice to cancel.

 

3. Confirming that your offer is valid for 14 days only, after which it will be withdrawn.

 

You'll find similar letters on other threads, to use as guidance.

 

It's unlikely they'll accept your offer and I'm not certain they should given the circumstances you've described. However, there's little they can do about it. Try the letter and see how they respond so we can offer help. Send the letter from the PO and get a free Certificate of Posting as proof to keep.

 

Sign up to the new gym which you say is more convenient.
