The van I drive has just had a letter through the post to my company saying I was first viewed on the private car park at 9:53am and second viewed at 13:50pm and the maximum stay was 2 hours but I was there at both of those times but in between those time I was nearby in the van at a building site working, this car park was local for shops ect does anyone know if I can appeal thanks

if you are happy to take this on then get your company to name you as the driver and they can write to you. That will waste a few pence and a couple of days of their time. When you get the demand you ask for "strict proof" that the vehicle was parked for the intervening time as you were visiting on 2 separate occasions so you will demand to see EVERY image (suitably redacted) captured between those times that day and will ake a SAR under the DPA to get the said data if they deny you your request.

They probably wont comply but that will kill any claim they may have so not a problem for you..

dx

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Appeal the Penalty Charge notice it will be rejected.

Then wait for the all important POPLA number then appeal to POPLA. Read the threads in regards to this as there are plenty to chose from

If I have been of any help, please click on my star and leave a note to let me know, thank you.

It is NOT a Penalty Charge Notice.

UKCPS are members of the IPC, so no POPLA.

If your company is willing to deal with it with you, then they should state, as RK, ' that the driver visited the site on two separate occasions, so please prove otherwise'.

Or they could name the two drivers of the van at the two times mentioned... wink.gif

Or do as ericsbrother says in post #4.
