@lidluk Athena parking 'fine', lidl carpark **WON CANCELLED**

Hi,

 

I am a totally clueless newbie to this and genuinely somebody who likes to tell the truth

and probably ends up getting advantage taken because of it..

I would love some help in dealing with my current issue.

 

Short version:

 

Girlfriend on way home from london to Wallington train station which is right next to lidl's car park.

 

 

I am a worrier of partners and recently in the area we have had a few police incidents with regards to females attacked in the area.

 

 

Nevertheless I get to the empty carpark a little early and enter the car park at 23.01.

 

 

I didnt notice the signs but they are clear and in the open.

 

 

my girlfriends train is late only by 3minutes but I leave the car park at 23:23 and drive home.

 

 

This was 4 days ago.

 

 

Letter was sent to my partner who's the owner of the car (im insured driver)

and I decided to simply email them my justification and below is what I wrote:

Hi,

 

I am appealing this decision based on recent events within the Carshalton/Wallington area

which have prompted me to be worried for my partners safety.

 

 

There have been some recent police incidents in the area namely:

a woman attacked on our road (link to report) & a school girl being raped in a nearby park (link to met police report).

 

As you can tell I was only in the car park 10 minutes longer than the apparent 10 minute limit for non-lidl customers.

The signs don't state any sort of time limit but more importantly I was only parked to pickup my partner

whom was on the Southern train from victoria to wallington (train ref: train confirmation link).

 

I hope if you read this, you understand that I was not looking to take advantage of your property

- I was simply looking out for the safety of my partner and felt I should at least contact you, to mention this.

 

I sincerely hope you void this fine based on these facts and I will look to be more aware of the limitations on the car park.

So after reading old threads on here that i googled I am worried that I've admitted

I am the driver and even more worried that if I ignore the letters

I will become that statistic whom pays through the nose.

True, apologies.. its a 'civil parking charge notice' problem is im so tempted to just pay it.. purely for peace of mind.

yeah I've had a look through most of the relevant threads in your link.

 

 

I've gone from thinking 'its just 45 quid' to 'nah im going to ignore'

 

 

to suddenly 'I can win this as POPLA' because the car park was empty, lidl was shut

and I doubt being in an empty carpark an extra 10 minutes constitutes to a £90 fine.

Don't "Pay " them. .... You've got to be joking me !!!!

 

What loss have they incurred ? The shop was shut !!

 

Have they responded to your appeal ?

 

Can you get a photo of the signage and post it up ?

Is there a sign at the entrance to the car park ?

They get 35 days in which to deal with your appeal. They then reject it and issue you a POPLA number appeal that to Poplar and get the PPC to prove loss

 

 

If they try it on breach of contract then a District Judge (DJ) from Norfolk ended that argument case law is there for viewing

Reviewing the images I may want to get something a little less pixilated... The sign says:

Last paragraph is the clincher. So funny this (not) its an invalid contract therefore unenforceable. Hence these stupid PCNs (Parking Charge Notice)

Right well I have an update to post..

 

It got cancelled. They sent a letter that came today. Just said it was cancelled - no reason for why. Only interesting thing about the letter was that it said 'dear lidl customer' which I wasn't. I did however bang on at lidl's uk twitter account and got a 'please let us know how your appeal goes' tweet. There was no POPLA process required.

 

So all in all a success!
