I am hoping someone can help me please,

 

 

today I had a visit from a JBW Bayliff,, who was pursuing me for a council tax debt from 2011 from a previous property,

 

 

In all honesty I thought this had been dealt with,

 

 

he told me the LO order was put in place on the 24/10/2012 and that he was here today to take my goods,

I explained that i thought it had been dealt with and I explained that I was going to phone the local council to get clarification

as I already had a earnings attachment order on my wages, and had a previous attachment that had now been cleared,

 

 

he said he would give me 5 minutes to sort it out,

 

 

i locked my door and phoned the council,

the council explained that the money was still outstanding,

and that they couldnt find the attachment of earnings that i had already paid off,

 

 

then the bayliff came back banging on the doors and windows,

 

 

i was still on the phone at that point to the council,

i opened the door and told him i was still on the phone,

he went back to his car,

he never provided me with any paperwork etc.

 

 

turns out the debt was still owed despite me thinking it was paid,

he wouldnt leave and kept on returning to my door,

now normally i wouldnt of ever opened the door,

and with me just recovering from an operation i was highly emotional,

 

 

he wouldnt except a payment plan or give me 14 days to sort it

because, he said 3 letters had already been left and that he had no choice but to take goods from the house,

 

 

i told him he wasnt setting foot in my property and he said he would take the campervan parked on my driveway which wasnt mine,

 

 

i went into full panic mode and phoned my mum in a distressed state,

who just paid the amount via her card to him over the phone,

 

 

now the debt is cleared,

however now that i have calmed down and thought about it,

i am still unsure of the charges.

My original debt with the council tax was for £287.54 and in total £597.54 was charged?

I only received a receipt,

no other paperwork provided and i don’t think he was certificated,

i really could kick myself for not being on the ball,

as im currently with step change looking at bankruptcy due to a messy divorce

and the ex declaring bankruptcy leaving me with huge debts.

Are these charges correct?

did you get all the previous letters from him?

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I never received a breakdown of the charges

 

 

I guess the £310 added to the amount is the charges for compliance and enforcement fee,

 

 

I never received any paperwork

 

 

I have not had any letters from JBW even though he argued the point that they always post them through the letter box.

 

 

I am phoning the council regarding the actual amount as the property the council tax charges are from was repossessed on the 1 October 2012,

 

 

I left the property in Feb 2011,

 

 

i am assuming the charges are because the ex husband didnt pay the council tax after i left

and due to his bankruptcy i have been left with them,

 

 

oh well as long as the charges are correct!

There do seem to a lot of different scenarios about has happened here. The good thing at the minute is that it is all over and you can now sit and ask for all the details you need to see if something went wrong somewhere. The people to direct all the questions at appear to be the Council.

 

You need to speak to someone at the Council and ask the following questions:

1 - how many Liability Orders they have against you

2 - the dates they were obtained

3 - the addresses they were for

4 - the period of time each covers

5 - how much each one was for

6 - how much is still outstanding

7 - the dates they were passed on for enforcement

8 - the dates & amounts of any payments

9 - how many Attachment of Earnings Orders did they have in place & how much & when payments were made - do you have records of payments (payslips) or can your employer provide details

10 - why did it take them so long to send it for enforcement

 

If necessary you may have to contact your local Councillor(s) to intervene
