Parking charge ticket stuck to driver window, now stuck in window mechanism.

Hi all,

 

 

My wife had a parking charge/fine stuck to her driver window yesterday. Unfortunately the windows all opened when she remotely unlocked the car when approaching and now the ticket is stuck in the window mechanism in the door cavity.

 

 

Fortunately the window is still working but where do I stand if either, the window stops working and need a repair/is damaged, or the ticket needs to be removed by an engineer (I`m not a techie) to prevent damage happening? Either way a cost we`re not happy to stump up.

 

 

As an aside, the ticket was "incorrectly" given as the system mistook an F for and S when paying over the Ringo mobile service but that`s another issue. I`m going to have to wait for the post notice to arrive to find out who issued it and what the details are. Then I can appeal etc.

If you are the keeper of the vehicle rather than your wife I would be writing to the company as the owner and complaining about the issues as described (dont say who was driving at the time but just say the driver did this or that) and say thast their operative has a duty of care and that the placement of a sticky envelope in such a position has forseeable consequences so you expect them to pay for any damage done to the car by their action of their employee or servant.

I would also write a letter of complaint to whoever the landlord of the car park is and tell them that they cannot avoid all liability for the actions of people they employ to manage their estate and that in the event of a civil clai they will be named as well as the parking co.

They might not bother to answer but should your car suffer a mechanicla problem within a reasonable time because of the stuck ticket then you can demand they pay for it otherwise you will take legal action to recover the costs of the damage. They are thus warned.

Is it "usual" or "reasonably forseeable" that the windows all open when a car is unlocked?.

 

If you want to claim their actions were negligent, the consequence must be "reasonably forseeable".

My car doesn't open all the windows fully (or at all!) when unlocked .... why did your wife's car? does it usually?.
