      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

How exciting. Those nice people at Rock Law who have been so nice trying to contact me from a Birmingham number - 0121 6152941 finally spoke to me today. Very strange because when I tried to call the number, it wouldn't ring. They were really keen to talk to me because they had been calling me repeatedly although strangely each time I answered there was silence. A loose connection I expect. Anyway, we finally spoke. Very nice guy called Gavin with a Welsh accent and he told me that he was in Swansea even though his number came from Birmingham very clever of these people to be able to do that and to be in two places at the same time Swansea is a very nice place I know because I've been there and he told me that I had some PPI which needed to be reclaimed and he also told me that every loan ever made by any bank in the last 25 years had PPI embedded in it and could be reclaimed. Wow and he was from Rock Law Rock like the stone and law like the police he said and he laughed because I think that it was meant to be a joke and he was going to send me an email to get things going but he wanted some personal information first and he really tried to persuade me to give him the information even though I said that I was worried about handing personal details over the phone to someone I didn't know but he was very nice and I nearly trusted him but not quite and so he said that he couldn't help me if I wouldn't tell him my birthday and I wouldn't so he went.

So if he 'knows' you have ppi, then logic says he must know your name and accounts and numbers etc so why does he need those again!

 

 

This is the same as the figures that come out saying '60% of pensioners are not claiming their entitlement'. Well if they know there are 60%, then they must know their names so why don't they write to them and invite them to claim.

 

 

The problem with these type of calls it that a lot of people fall for them. Then what happens when there is nothing to reclaim but they get a bill because these lovely companies did some work looking and think they are entitled.

 

 

I so wish there was some easier way than a national tv advert to tell people they do not need these companies and can make twice as much by doing it themselves.

Yes, the new financial penalty regulations came into force on the 29.12.2014 under the Financial Services (Banking Reform) Act.

I think that our advice is to steer well clear of Rock Law. Any firm which routinely breaks the MOJ regulations is clearly not to be trusted.

 

In fact steer clear of any Claims Management Firms. If they weren't running CMCs, they would be running Private Parking or Retail Loss Prevention - and if they weren't doing that they would be running Debt Collection Companies. You know the type.

I like a fool after buckling to their hard sell last December.

Being told I was due inbetween 2/3 thousand pounds. and it wouldn't take more than 12 & 16 weeks

 

 

I decided to let them find this ppi,

I told them I was sure I never had, then I would definately not be out of pocket whatever happend, with some second thoughts after giving them £300 deposit,

 

 

I had secong thoughts and rang back and cancelled.

 

 

Within a couple of hours a David Tompkins one of the bosses phoned me and persuaded me that I really had all this money to come back.

 

 

He lowered the commision and the deposit to £200 and need less to say I have just found out that they have gone into administration,

am now left trying to get my money back.

 

 

they prey on the vunrable, I'm a disabled person living on benifits and informed them of this at the time.

I can answer why 60% of pensioners don't claim their entitlement. They do not want the hassle of continually filling out paperwork and informing whoever of the minuate of their lives, financial position or where they are going for the next couple of days.

 

I'm having enough trouble with the local council over a housing benefit/council tax claim - they want every blessed bit of paperwork in triplicate with a detailed letter of why I have had so many holidays this year and not worked and not previously claimed- err, I had the money to do so you plonkers, plus the hassle you have given me is hardly worth it.

 

As for Rock Law, I thought it was against the advertising standards code to include words such as Law in the title of a firm when clearly they are going AGAINST the law.
