      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I moved to France in 2004 and have recently been reading about PPI claims. All loans were paid off before I moved. I have found paperwork with account numbers on from Blackhorse and Masterloan, is it worth finding out if PPI was added or is it too late?

Not at all. Send Subject Access request to the original creditor this will provide you with information that will help you establish if there was PPI included. If so, then you should then complete a spread sheet and the FOS complaint form - send to Original Creditor/Lender and ask for your money back.

 

SAR template below - you will need to include £10.00 (statutory fee) and they have 40 calendar days to comply.

Don't necessarily accept any denial at face value. If they say that there was no PPI, do further research

Might do. Some banks keep records on .microfilm. But the staff won't tell you because they know they'd to pay out a small fortune

I have a joint Lloyds bank account with my partner which we still use and my partner had a Lloyds TSB credit card now finished, do I have to send a SAR for each one?

I'd think if you both signed the SAR request you should get all the info they have on both of you, I'd do that first and see what they come back with.

Hi, I have received the SAR request from Lloyds for my partner, they wanted another £10 for me as well which I was in the process of doing. They have sent me bank account statements from August 2001 and credit card statements from January 2000, they say prior to this statements no longer exist although they did send a copy of the credit card agreement dated 6th April 1998 which is in both of our names the PPI box is ticked even though it states my partner was self employed and I was a housewife, sentinel card service box is also ticked. Looking at the credit card statements there is card holder protection plan payments taken out every month ranging from £13 to £34 is this the same as PPI? They have also sent me a screen shot of the loans he has had, but they say they are unable to provide copies of the original loan application documents due to amount of time that has elapsed. 1 was started in 02 1992 and finished 06 1998 so have no idea if PPI was added, the other was started in May 1998 & finished in May 2003, don't know if PPI was on this either.

 

Could anybody tell me where I go from here please?

Lloyds upheld my claim on 2 of the 3 loans, one going back to 1998 received a cheque for £1900, have also received an email this morning to say they are upholding my credit card claim and are in the process of calculating the redress.

Make sure you calculate it as well to ensure you aren't being shortchanged

It was a loan my partner took out in 1992 before he went self employed, they said there was not enough evidence to show that he had ermployee benefits that meant he didn't have need for PPI policy

Thanks for that, I was self employed when I took out any loans, still in the process of getting them to pay out.

 

Good luck, with your claims. Lloyds paid out easy enough on the loans & credit card my partner had when he was self employed, citicards are the ones who won't pay

Agree with this. Doesn't seem a lot considering how long ago it was.

 

What reason for misselling dud you give for the claim that was rejected?
