Hi

I need someone with the expertise for help.

 

I had an account with Littlewoods everything was fine but due to my partner

and myself in and out of work I found it difficult to keep up with the repayments.

 

Littlewoods then passed it onto Lowells and being new to all this

I agreed to make payments to Lowells but I cannot and did not keep up with their demands.

 

Today I have received a LETTER OF CLAIM from bwlegal demanding I pay £180.00 by 15.1.15,

if I don't then they intend to issue a claim against me in the County Court.

 

I have every intention of paying this debt but cannot afford what they are demanding.

 

 

Can someone please help me and advise my next step- I am at my wits end.

Let me be the first to say please relax, Lowells is a DCA meaning they can't send Bailiffs, there all bark and no bite.

 

Contact Littlewoods not Lowells with this letter.

Only sign if you've signed something before for them or it's not needed. This letter can give you some breathing space. So you can either come up with the money. Only pay what you owe, Do not pay any of Lowells charges or interest.

 

Also check your statements for any "£12" charges, if you have any you can claim them back. we will run you through how if needed.

 

If you can't come up with the money, you'll need to do a budget sheet and give token payments of £1 until you can.

little point in pulling littlewoods string.

 

 

how old is this debt?

 

 

is this on your credit file?

 

 

how much of the debt is £12 ENALTY fees from littlewoods

and have your their PPI too?

 

 

cat debt are VERY low priority.

how much of the debt is £12 ENALTY fees from littlewoods None though on the letter of claim there is an estimate interest charge of £43

and have your their PPIlink3.gif too? No

have you ever sent lowells a CCA Request - No

 

So would my first steps be to cca Lowells and write to bcleagal and say that I am disputing this?

I sent a cca letter to Lowells and I also sent a letter to bw legal stating my financial situation and offering a payment, but they have just ignored me as I have today received a court claim.

 

 

I now need to log on to moneyclaim and respond - Please help

 

 

I am now worried I will end up with a ccj

bit of bad news

 

when i went onto moneyclaim.gov i signed in i had noticed mt partner had already gone ahead and filled in the defence and offered them £47.00 instead of the original offer of £4.70 i had offered them by post .... !!! ANNOYING !!! is a understatment

 

help ! so can i rettract and edit the defense that my partners had input unaware of what they are doing.

yes i have stressed that to my partner!

 

i have tried to amend the document but there is no options to change the text looks fully submitted ....

 

What i can do for now is fill the postal claim and give the court a call in the morning saying i have made a huge mistake and see if i can retract the document and start again

Have you defended in full ? what defence has been submitted ? There is no provision to make an offer if you defending in full...unless you have made a partial admittance?

Have you defended in full ? what defence has been submitted ? Their is no provision to make an offer if you defending in full...unless you have made a partial admittance?

I think what has happened is during the confusion we have ticked the partial admittance as we have already sent an offer of reduced payments a couple of weeks ago to bw but they did not reply. It is only now that i realise that bw mayben ot who i owe but littlewoods - I feel that I have made a total mistake and do n't know which way to turn now.

 

Wou ld ibe able to ring the court and explain my error and ask if I can amend? :???:

As the claim was only issued 5 days ago...you still have your 28 days if defending in full...ring MCOL Northampton and explain that you would like to retract your plea and change it to defend in full. MCOL will advise.

As the claim was only issued 5 days ago...you still have your 28 days if defending in full...ring MCOL Northampton and explain that you would like to retract your plea and change it to defend in full. MCOL will advise.
