Hi there,

We are currently having a similar problem with David Lloyd and ARC.


Was your situation resolved?


We signed a 12 month contract and paid up front on the basis that I was pregnant and would be on maternity leave after the 12 months. We explained this to the sale man who failed to notify us that we needed to give 3 month's notice in writing to cancel even if we have paid 12 months up front.


Before the 12 months ended we received an email asking us to contact them to continue our subscription. I ignored this thinking that it were a sales and marketing email. There was no mention that if I didn't contact them, then I would be liable for more fees past our 12 month contract.


The salesperson (being in full knowledge of our financial situation due to my pregnancy) and the email have all failed to clearly let us know of the 3 months notice period.


We are now being pursued by ARC daily for over £600!!

I am not working (maternity), have no income, and the DL salesperson knew that this would be the case. What can we do?


We have tried to contact the manager in our branch who has told us simply "you signed the terms and conditions"

DL have a nerve trying to get a further years fees from you for the 2nd year.


Have you checked through the T&C's of the original agreement to see what was said about auto-renewal and about 3 month's notice being required.


Please confirm about both these points for us to review.


Ignore any contact from ARC for now - they are pretty harmless and have no authority.
