:!:Hi all,

Just wondering what options my sister has.

She need to pay rent on the 01/01/2015 but she spent too much on Christmas and has no more saving. She is thinking of paying late or a payday loan.

She needs to pay £375

What would be best for her to do?

Thanks

Andrew

Hello there.

Paying rent late could well cause other problems with the landlord.

I think a PDL is a really bad option that often has a knock on effect. If she really can't find the money any other way, she could speak to her local credit union.

Perhaps speak to the landlord and explain that you need extra time to get the rent together. However, all furutre rent payments will be on time.

Whatever happens, stay WELL away from PDL's. it might give you the money now, but what will you do when it's due for repayment? Especially when you consider their extortionate interest rates and collection practices.

I think the message is pretty clear...

Not long ago there was an announcement on here about these loans for Christmas...

General idea...

STAY AWAY FROM THEM!...

Anyway go speak to a Credit union.

We could do with some help from you.

Credit unions will rarely lend anything unless youve saved with them for a couple months first.

Thank you for all your replies,

I thought the same about her getting a payday loan but she wanted to know. Her boyfriend just told me he's had loads of overdraft charges in the past and recently. Like £1 a day and £5 a day if over the overdraft.

He's wondering if he can claim them back so he can pay rent or pay a credit union loan quicker.

Thanks

Andrew

If the banks charging him that much per day for an over draft, perhaps get a BCOBS complaint in

One payday loan generally leads to another, and another and they will also harm your credit rating for a long, long time, despite what they may tell you.

If your sister is looking to get a mortgage if she has had even one PDL in the last 5 or 6 years no lender will look at her nicely and she will have lost any 'set up' fee they may charge to look at getting a mortgage with the relevant company.

It is a very slippery murky slope to go down.

Is this Council or Private rented?

When would your sister be able to pay the £375 rent?

As if it's within a week or so, then call your LL/LA & explain that with the Christmas holidays, the rent is going to be a few days late & say it can be paid on the 5th & pay it on that date. (or whatever day it is, as you want your LL/LA to take you for your word).

If it won't be until say the following month 1st Feb, then call the LL/LA & again be truthful & ask if it's possible to pay the missed rent along with February's.

Some LL/LA will be okay, some will not & will charge £x for the missed payment. I'm in private rented & my LA charge 8% for a missed/late rent payment, hence why mines paid on time!

I most definitely would not go to a PDL under any circumstances!!

Sometimes just being honest & truthful about your situation can go a long way. Esp if your sister has never missed her rent before.

As long as the arrears are not 8 weeks+ she should be okay. As it's only when your 8 weeks or more behind, that a LL/LA could take Court action.

I do hope your sister is able to get this sorted, good luck!

I don't suffer from insanity, I enjoy every single minute of it!!

8% is an arbitrary amount. So its a penalty charge. Reclaimable.

Ok thank you for your replies,

I will get my sister to talk to the landlord and see if they can work something out. She told me it would probably be early Feb before she'll be able to pay.

That's why I'm trying to get her boyfriends bank charges back.

This is the letter I'm going to send to Halifax, along with his monthly income, outgoings and a statement of charges.

Letter:

Headquarters

Trinity Road

Halifax

West Yorkshire

HX1 2RG

Date:31/12/2014

Dear Sir/Madam

Account number: 00000000

I am writing to reclaim all bank charges on my account(s) since the 01/06/2011. I am unhappy that these charges have been applied to my account and in this letter I am registering my complaint and I request that you immediately stop applying further charges to my account.

I need you to consider my case as a matter of urgency as I believe due to the charges to my account I’m suffering serious financial hardship and becoming unfairly indebted. In particular, my ability to pay rent, mobile phone contract, food, clothes and basic essentials. Also having my partner becoming ill my monthly income has been significantly lowed, so I now solely rely on my wages and my partner’s statutory sick pay (SSP) for my income. I will attach evidence to show my monthly income, outgoings and a statement of charges.

I therefore request that you repay all my default charges since 01/06/2011 which total £291.

Under the FCA guidelines, Halifaxhas 8 weeks to resolve my complaint. I trust that you will deal with my case within this period. If not, I will refer the matter to the Financial Services Ombudsman.

I look forward to receiving a full response to this letter within 14 days

Yours Sincerely

Signed

Name Printed

I'll upload the Statement of Charges and the proof of income is just copies of payslips from my sister and her boyfriend for the last 3 months.

Should this be ok for claiming back the charges?

Thanks

Andrew

Is it just the normal 8% I put in the APR box?

Thanks

Andrew

I will ask for you :)

I thought it automatically added the 8% interest.. but obviously not.
