Cabot Chasing old CAP1 'debt' is it SB'd??

Hi guys,

 

 

I have checked our credit file and the debt that Mortimer Clarke Solicitors are chasing my wife for is no longer on her credit file.

 

 

How can I find out if this is statute barred.

 

 

We remember the debt but we are sure its at least 10 years old.

 

 

We do know it has been passed around different dca over the years.

 

 

Now had this letter from solicitors for Cabot.

Statute barred occurs when there has been a 6 year period ( 5 if you live in scotland)

where you have not paid anything towards the debt, or acknowledged it in writing.

 

If it has been passed around multiple DCA's then it is very much a bad debt.

 

 

However, cabot doesnt care, and they have been known to issue claims regardless of the debts validity.

 

 

They rarely, if ever have any paperwork for the debt,

 

 

if they are threatening you, you could simply deny all knowledge of the debt,

put them to strict proof of it

( theyll try and claim that you made a payment in late 2009),

or send them a CCA request while still denying it, and putting them to strict proof.

when was the last payment/activity on the account

thats too small to read

if then after checking your records not sure when you last paid anything, then do a sar to start.

a sar to the o/c shld show payments to them prior to it being sold.

how about looking at an old copy of the cra file

when it was showing?

 

 

should have payment history

You need to check an old copy if possible. SO you know some of the history of the debt.

SB has nothing to do with your credit file.

 

 

It is as explained above in post #2.

 

 

You need to start doing some homework on the history of that debt,

 

 

and be 100% sure of the results,

 

 

as cabot and restons WILL claim you made a late payment.

 

 

Of course, it's on them to prove the payment was made,

 

 

but if you have the facts to hand,

 

 

you can throw the book at them and get the regulators involved.

I am aware that SB has nothing to do with the credit file.My question is if it isnt on my file then surely it must be older than 6 years old

 

DOesnt matter about the age of the debt. You need to check if the related info has been met, and also send them a CCA request. Cabot rarely ever have the correct paperwork needed for a debt. Sadly very few people realise this which is why they are still in business.

or written ack of the debt

with a signature.
