LLowell claimform, old LLoyds debt

Hi

i have recieved letters for ages of LLowell chasing me for a very old Lloyds tsb debt.

 

i have never answered their calls or emails,

 

 

recently i had a letter from solicitors working for Llowell again i ignored .

 

now i have had a court letter from nothhampton bulk services court.

of which i am defending claiming the debt is statute

 

ive also asked for them to prove i owe the debt as it statute .

 

 

the solicitors have said we have passed it back to LLowell and have put the courts on hold and

 

 

LLowell they have now said they are not dealing with it but a company called Fredrickson and to contact them.

 

but whilst looking into my credit file late last year Llowell updated my records on the debt,

 

 

up untill Llowell had it it was defaulted for years then november last year it was updated by LLowell to a green status for 1 month.

 

 

i believe this was done to reset the SOL.

 

 

as i have had no contact with anyone,

 

 

made any payments or anything so see no reason why it should be marked green

 

i then went back onto the courts (online) to file a seperate claim against Llowell for unlawfully updataing my credit file with false information.

 

 

but i need to send a particulars of claim to them

 

 

can anybody help with this?

one confusing story.

 

 

the default date is nothing to do with SOL.

 

 

updating the file cannot change the original creditors defaulted date.

 

 

lowells/freds/carter/BW are all the same desk.

 

 

so the claim is currently stayed?

 

 

I'd be dropping the claim regarding SOL/CRA data etc etc

Are you sure the claim has been stayed with the court ? You need to telephone Northampton tomorrow morning and confirm this. You will need the claim reference number - top right hand corner of the claim form.

 

Just ask the clerk, "What is the status of this claim, please"

 

It has not been unknown for "phantom" payments be made to the account so you need to keep on top of that.
