    • Just had an email re the my breache in agreement by her rep.   I asked you yesterday if they had asked about her name in the thread being removed.   The issue they have is the Elizabeth turner and genetic pups entry on google.   they knew I did not put it up and told them so in court.  I dnt know how to post on google.   I told them I cannot remove what I did not post.  when i come back here and saw her name gone from threads title, I presumed her reps sought it.   now I get an email saying her names still on google ur breaching the agreement as it’s still on google.

    • How does one obtain the permit? The permit team number is only open between the hours of 9am to 3pm Mon - Fri. It says on the website, To obtain an additional 2 hours, the driver must pay a tariff of £3.00 + booking fees in person at our Security Hut, is that how you get the permit also, from the security hut? What a rigmaroll that would be but maybe just another step to take to try and catch people out?
    • Anotheruser0000 bear in mind that not all Judges are equally versed in the PoFA regulations. Fortunately now most of them are but sometimes a Judge from a higher Court sits in who is well experienced  in Law but not PoFA. and so they sometimes go "offkey" because their knowledge can raise a different set of arguments and solutions. It does seem particularly unfair  when the decision is so  bad . it can also be that in some situations the motorist being a lay person is not sufficiently know ledgeable to be able to counter a Judge's decisions in a way that a barrister could.
    • The argument about the date of receipt is now dead because the PCN  does not comply with the wording  of the Protection of Freedoms Act 2012 Schedule 4.  First reason Section 9 [2] [e]  "state that the creditor does not know both the name of the driver and a current address for service for the driver and invite the keeper—(i)to pay the unpaid parking charges;" Second Reason Section 9 [2][a] "specify the vehicle, the relevant land on which it was parked and the period of parking to which the notice relates;" All your PCN does is mark the time you entered and left the car park. It does not include all the myriad things you do in between-driving into the car park, looking for a parking space-perhaps a disabled space or  parent and Child place@ getting the children or disabled person out of the car then going shopping. Coming back; loading the car with shopping [, getting the children or disabled into the car, taking the trolley back to the store; driving to the exit perhaps stopping to let vehicles/pedestrians cross in front of you etc. so subtracting the driving times from before and after parking can make quite a difference from their time to the actual period parking time. So the upshot is now that only the driver is responsible for paying the PCN and the keeper is not liable at all even if the name of the driver is never known by Nexus so well done for not appealing. You obviously want to keep it that way to make it very difficult for them to win in Court if it ever goes that far. Although your question is now moot since  the same objective has been achieved by the non compliant PCN [ie no keeper liability] just  about the only way to dispute the timing of the PCN would be if one kept the envelope and there was a discernible date stamp on it that did not match the date on the PCN. There is a new Act coming out [and it cannot come quickly enough ] and one of the things required is that parking companies will have to prove the date of sending out their PCNs. We are not the only ones who sometimes doubt the veracity of their dates particularly as the later it is sent [unlawfully] the shorter the period motorists have to benefit [?] from the reduced payment. I haven't seen it on your posts but do you know how long you are permitted to park for free?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Someone who signs on daily like me when he was in on Friday he was given a date to sign back on again after the holidays and he said to me the adviser who signed him on said the office for the computers use is open to Wednesday if u would like to use them he said no he can jobsearch at home she said something back but he can remember what but was he wondering will anything happen if he doesn't go in to use the computers? Or nothing can happen due to not been given a letter or a mandatory letter to come in to the office?

 

He would like some info because he doesn't want to be worried about having money stopped.

Using JCP It for job searches in VOLUNTARY unless he is MANDATED by letter to attend and do his job searches. No need to worry, nothing can be done.

I was having a look to try find any guidance about using the computers in JCP but couldn't so that's why I asked on here.

That goes for anything that is not listed in a JSAg or client committment as well. A JCP 'coach' can say for instance "you may find it useful to xxxxxx" or "we are open on xxxxx for you to use the IT" but if you are not mandated to be there you are there voluntarily. I keep saying this to attendees at the work club I run, a lot still think DWP/JCP are my boss and they HAVE to attend - they don't, it is voluntary

Ye I don't have must use computers in at JCP on my CC sheet neither does this person.

 

I told him that the date on your sheet u were giving that's the next time u just attend so between Friday last week and over Xmas and new year he doesn't need to go in to job centre.

 

I use computer at home I told the sign on advisor

 

Yeh I only use the computers like 10 mins before I sign on instead of sitting on a chair waiting

After 3 months with them seeing them fortnightly my 'adviser' said she wanted to see me every week so I said "OK, if you canput that in writing that is fine as I will need to be in town anyway to go to the library" She said "it's OK, I will just put you in my diary" so I said "No, I want a letter" It never materialised so I ignored the diary appointment and she threatened to put in a doubt against me - I told her not to bother but she did anayway. I saw my JCP adviser later that day who I actually got on with and he said "well she has just wasted her time as you were not mandated ... I will also note on my system for your payment to be released"

I'm not surprised about this heard it so often.

 

It has to stop and stop now because it's becoming a joke they have to sort the rules out and stop trying everything to get people sanction it shouldn't happen in this day in age.

 

I get told if anything comes up with getting told to attend this and that and no letter for mandatory is given go to citizen advice they would help.

 

Plus the system should tell u if any letter was giving out and when and what time to prove it if not then u should win the appeal

I would like to also add according to the government sanctions are just like in a work place but I would argue against this as in a work place u are given a warning or a final warning what warning or final warning do u get before a sanction? None!

 

A older guy who signs on I was speaking to him about sanction and I told him what I said above and he said that's a very good point there should be warning or final warning so if u do it next time there will be a sanction because u should have know he said yeh because know one actually knows the rules in job centre for getting sanctions

That's the problem; most people think that whatever a JC adviser says is the gospel truth. Far from it.

 

I used to believe them myself until I started doing my own checking on guidelines and then found helpful sites like this one and whatdotheyknow.com. I was shocked at just how many lies are told to claimants, either through ignorance of the guidelines or sheer malice on the part of the JC adviser, looking to meet sanction targets.

 

The guidance on sanctions quite clearly states that they are to be used as a last resort - which I take to mean after having tried all other methods and giving the person several chances to do what is asked. Instead of this, sanctions are imposed immediately, usually with the unfortunate victim not even being told it's happened. First they know is when they go to draw money out and it's not there.

 

The whole system needs a radical overhaul, with advisers being trained and tested regularly on the guidelines, along with suspension of pay, dismissals and in severe cases, prosecutions for those who don't meet the standards. Bottom line is, they're all agents of the government and should be held accountable for carrying out the regulations.

 

Always get things in writing - signed and dated. If the adviser isn't prepared to state it in writing, it's almost certain they're lying about it being a 'requirement'.

Ye 'last resort' but yet I think they actually mean 'first resort' the whole system is a joke it does need overhauled soon.

 

Like I said at the start of this topic a person who signs on is not to sign back on to next year but was worried that the job centre may try a fly one to get him sanction for not going to his the JCP computers but I said he's not been giving a letter plus a sign on adviser can't give u orders can they? As there not there adviser.

 

He's not long off a sanction so u can see why he may be worried about getting another one as it would be 13weeks surely.

 

But to me there needs to be a clearer guidance and a fairer chance for job seekers

I say it many times, I say it again.

 

Sanctions when applied should not be allowed to take effect until either the claimant accepts the sanction OR exhausts the appeals process.

 

Thankfully at least ONE of the parties wants to overhaul; the sanctions system now. Shame its the one that stands nil chance of being elected.

What are the job centre open for if no one is to sign on between 22/12/14 to 5/1/15. Is it for claims?

And will there be many advisers in the job centre.

 

There's plenty of processing and paperwork to be done. Lots of businesses and government offices are open on the non-holiday dates around Xmas and New Year even though the general workload is less than normal. There will probably be fewer staff than normal since many of them, especially those with kids, tend to take holiday time.

If an "Employment Officer" (the title used for JCP advisers in the legislation) issues a direction verbally and makes note of it on the LMS (the DWP computer system), it can form a valid Jobseeker's Direction.

 

My opinion: It is in the best interests of the claimant to get all Jobseeker's Directions in writing and contest any inappropriate directives before they are entered in to the LMS.

Well I wasn't told to go in to use computers this week as I told them as I'm not signing on I don't need to come in to use them and I have my own computer and was told we are open mon tue and wed if u do need to use them. Of course at the start of the topic the man was told bit more info.

CBA to wade through all DWP documents, but it is hinted at in the UJM Toolkit manual:

108. [...]

you must formally notify the claimant of their obligation to apply for the job, and what the expiry date is, by either telling them:

 

  • face to face; or
  • by telephone; or
  • by letter.

109. You must also record you have notified the claimant and Job ID number in ‘LMS Conversations’

Thanks , i was asked to sign a paper but that was for been giving a attendance after holidays my next 3 daily signs on and would see next time I signed on and if I needed to use the computers then I could come in and use them.

 

I don't see why she would book me anyway on the computer if I don't need to use them but the other person I was talking about at the start of topic not sure about him.

 

Do u know if sign or my adviser or others would be in office today?

Does any one know if u have a doubt over Christmas how long have the adviser got to tell u before everything goes ahead ? Or do u get contacted during days there open between Xmas and new year?

 

Just like some info on this to know for next time and of course for anyone on here who needs that info also thanks.

Im sure the advisor has to state what the aim and objectives are for daily siginng. There has to be a "benefit" that aids your jobseeking. Maybe ask some peeps her if there is a way to challenge it

To be honest I think daily sign on are just because u aren't getting out to the work experience for 6 months

I would like to add is there any sign on advisers this week at the job centre as while I was waiting on something a couple of people where talking about what they have been up to this week and 1 of them said he had signed on bla bla bla but I was thinking why would he be signing on as surely there would be no sign on advisers in the job centre from this Monday to in 2 weeks time.
