Name of the Claimant ? LOWELL PORTFOLIO LTD

Date of issue – 12 DECEMBER 2014

What is the claim for –

 

THE CLAIMANTS CLAIM is for the sum of £637.79

being monies due from the defendant to the claimant under an agreement regulated by the Consumer Credit Act 1974

between the defendant and HBOS plc

assigned to the claimant on 13/7/2013,

notice of which has been given to the defendant.

The defendant failed to maintain contractual repayment under the terms of the agreement and

a default notice has been served which has not been complied with,

and the claimant claims £637.79

 

The claimant also claims statutory interest pursuant to S.69 of the County Act 1984

at a rate of 8% per annum from the date of assignment og the agreement to date

but limited to a maximum of one year and a maximum of 1000 amounting to £51.03

 

What is the value of the claim? £818.82

Is the claim for a current or credit/loan account or mobile phone account? Current Account

When did you enter into the original agreement before or after 2007? Long before 2007

Has the claim been issued by the original creditor

or was the account assigned and it is the Debt purchaser who has issued the claim. Debt purchaser Lowell Portfolio Ltd,

 

 

I have a letter from Bryan Carter advising me that they have been instructed by Frederickson International

on behalf of our client Lowell Financial Ltd regarding your HBOS plc account to commence legal action

Were you aware the account had been assigned –

did you receive a Notice of Assignment? Not to my knowledge

Did you receive a Default Notice from the original creditor? Not to my knowledge

Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? Not to my knowledge

Why did you cease payments? I have never made any payments I am surmising that this is overdraft charges

What was the date of your last payment? None made

Was there a dispute with the original creditor that remains unresolved? Not to my knowledge

Did you communicate any financial problems to the original creditor

and make any attempt to enter into a debt management plan? No

I have sent a CPR request to both Lowell Portfolio and Bryan Carter

Can you tell us what kind of account it was please. Also are these charges on charges.

Please tell us how the charges were incurred.

You say you want to defend. On what basis do you think you have a defence?

Your timeline is as follows:

 

Issue date 12.12.2014 + 5 days for service = 16.12.2014 + 14 days to acknowledge = 30.12.2014 + 14 days to submit defence = 13.01.2015

 

Not the best way to see out the old year and start the new :(

I am trying my best but this court thing just came at the worst time,

 

 

I can only give you the information that I am aware of,

 

 

I haven't banked with HBOS for years so as you can appreciate it is not something that I am up to date with,

 

 

and for that I apologise,

 

 

but if you can help me with the information that I know it would be very much appreciated...regards Graham

As far as I am aware they are all charges which have just built up, it was a Halifax Bank account I assume, I don't bank with any of them now since the banking [problem] of around 2008

 

If you could try and establish the last time you ever used this particular account either making a payment to or from.

 

You can check your credit files by logging on to one or all of the 3 credit reference agencies - Equifax, Experian or CallCredit.

 

You can take out a 30 day free trial (do make absolutely sure you cancel before the 30 days are up) and check to see if this account has been updated on your files.

Ouch, so the default date is October 2010.

 

Can you see from the report if there was any activity on the account in/out for the previous 2-3 years ?

You might get a better sense of the situation when you receive your pin for Experian. Noddle is more of an overview, with the information usually collected from other sources. Whereas the companies actually report to the other 3.

You do not need to submit your defence until 13th January, so no rush ! andyorch will look in on you in good time - whilst you have received the letter you have from the solicitor (pompous donkey) it might be that you will receive paperwork prior to the submission date.
