My thought about you making the decision on your own to go with another lawyer is that three of you are meant to be beneficiaries of this will trust, aren't you?     • Hi guys, I am about to file my defence via email as cannot log in to the claim anymore.  Can you please advise if I can paste below and if it's good to go for now, or should I add anything else in?  Thanks!  The Defendant contends that the particulars of claim are vague and generic in nature which fails to comply with CPR 16.4.  The Defendant accordingly sets out its case below and relies on CPR r 16.5 (3) in relation to any particular allegation to which a specific response has not been made.  1.  The Defendant is the recorded keeper of vehicle xxxx xxx.  2.  It is denied that the Defendant entered into a contract with the Claimant - Parking Eye LTD.  3.  As held by the Upper Tax Tribunal in Vehicle Control Services Limited v HMRC [2012] UKUT 129 (TCC), any contract requires offer and acceptance.  The Claimant was simply contracted by the landowner to provide car-park management services and is not capable of entering into a contract with the Defendant on its own account, as the car park is owned by and the terms of entry set by the landowner.  Accordingly, it is denied that the Claimant has authority to bring this claim.   4.  In any case it is denied that the Defendant broke the terms of a contract with the Claimant.  5.  The Claimant is attempting double recovery by adding an additional sum not included in the original offer.   6.  The Particulars of Claim is denied in its entirety.  It is denied that the Claimant is entitled to the relief claimed or any relief at all.

    • Ooops - one to many also s..... my draft reply should read as:  Thank you for your response Mr Schnur  I set out my position quite clearly in my letter of claim and nothing has changed. Your insurance requirement is unlawful and is contrary to section 57 of the Consumer Rights Act, and also section 72 of the same statute. I would also refer you to the outcomes in PENCHEV v P2G (225MC852) and SMIRNOVS v P2G (27MC729).  My deadline for action - 1 May 2024 - still stands, and if P2G wish to avoid the addition of court costs and interest to my claim, you may wish to respond positively before that date.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have had type 1 diabetes since 1988. I have been told that my medical exemption certificate has expired (I did not know that this was the case I have not been sent any reminders and to my knowledge I have never renewed it since I was diagnosed). I cannot find it anywhere in the house (I have moved house twice since being diagnosed so it could be anywhere)!!!

Hi Stu

 

In 1988 the rules were probably different where there was an automatic exemption from precsription. Somewhere along the line it's changed where you had to apply every 5 years and they send you an auto renewal form. Again, I couldn't tell you how long 'the every 5 years' renewal has been running. I don't think you can appeal and it is 'very unfair'.

 

You could consider contacting your MP, see if they can intervene. A similar situation tp yours:-

Looks like the NHS is getting more proactive in preventing fraud, which is rife and costs the NHS Millions of pounds, like you I have a genuine illness which gives me the right to have a medical exemption card, this card has an expiry date on it and so did the three that I had before. Its stupid really as like you I have an illness that I will always have and will have to take the meds for the rest of my life.

 

 

The fraud investigations will pick up people like yourself who have a genuine right to free prescriptions but have not produced the correct documentation , you might call it harsh but the only alternative is to let the thieves get away with it with the end result being the NHS runs out of money and the likes of you and I having to pay for all prescriptions.

 

 

Your GP will have the form and will sign and hopefully you will get the same outcome as the poster on the other forum.

 

 

When you do get your card which is the same size as a credit card it will have a expiry date on I would suggest you keep it safe and always produce it, that way they will leave you alone and can concentrate on real fraudsters

There must be something going on in the NHS, because we are in exactly the same situation.

 

My wife has been Type 1 Diabetic for in excess of 15 years and has had free prescriptions the whole time. Just like Stu47803 we've suddenly received not one but two demands for a total of over £200 in fines and prescription fees. Until these appeared, we were unaware that the medical exemption could expire.

 

We sent off a new application form, signed by her doctor on Friday last week.

 

Whilst strictly speaking, they are correct (I assume!) that the exemption certificate has probably expired, we have had no reminders or anything...and obviously my wife has been diabetic and therefore entitled to free prescriptions the whole time(!)

 

Do you think it would be worth contacting them to say this?

for the past 13 years i have been on tax credits and when i first started on tax credits i received a card stating i didnt have to pay for prescriptions. i started work in january this year so i paid for a pre payment certificate as i believed i would no longer be entitled to free prescriptions. today i have received a penalty charge notice for the amount of £8.05 plus a penalty charge of £40.25 for a prescription i received in november 2014? it states i was not entitled to a tax credit exemption... after going on the tax credits website today it states i should of received another card every year but i never have so therefore i think i should of always been paying for them?.. i get between 1 to sometimes 5 items in a week and have done for years. im so worried now and scared i dont know whats going to happen, i never did this purposely and i never received a letter saying i wasnt entitled to them. i have paid the charge notice this evening but what happens now. i dont understand why it says november 2014 when i have received prescriptions after that..

Sorry to continue the hijack of this thread, but...I'm going to :wink:

 

I wrote to the PECS people as soon as my wife's new exemption certificate arrived, explaining that although the original certificate may well have expired she was still entitled to free prescriptions due to having a qualifying condition. I asked them to waive the charges based on this.

 

I've just go a reply, which is basically a one-liner saying "we've considered the information you provided but you must still pay the charges". The rest is just blurb about how to pay.

 

And to add insult to injury, the first charge has now passed it's early repayment date and has clocked up an additional £50, making the grand total £270. The letter telling us that the additional £50 is due is dated a mere 2 days before the one refusing our "appeal".

 

I've a mind to pay the second charge before it gets to it's early repayment date (this Thursday), but write back and complain about the additional £50 on the first charge and see if they will waive it, since we were waiting for their reply. What do you guys think?

I assume from this that you've been ticking box F on the back of the prescriptions that says "has a valid prescription pre-payment certificate" since January, and not box M "is entitled to, or is named on, a valid NHS Tax Credit Exemption Certificate"?

 

If you're sure you haven't, then why pay the charge? You should challenge them on it.

can i ask did you receive just the 1 letter or 2 seperate letters?

I ticked box m up until i paid for the pre payment this january as i thought i was entitled to it. I cant understand why if i wasnt that i have received the letter for only 1 prescription from november

 

So you're sure you haven't accidentally ticked it since then, and have been ticking box F instead on every prescription?

OK, so if you have a valid pre-payment certificate (I assume you purchased a 12-month one and not a 3-month one, correct?) and have correctly filled in the declaration on the back of the prescription itself, I'm struggling to see why they've sent the charge notice. And to be honest, I'm not sure why you've paid it.

They have sent it stating i was never entitled to receive tax credit free prescriptions although i received a card when i first went on tax credits i didnt know i should receive a new one each year, so thats making it look like ive got free prescriptions for approx 12 years and i shouldnt of. I got the pre payment 12mth one this january when i started work.

One of our checks showed that you received a prescription free of charge during november 2014, because you declared you did not have to pay for the following reason: you were entitled to or named on a valid nhs tax exemption certificate. As we could not find evidence of this you now need to take action
