Hi all

 

I had a PCN from PE March 2013 and sent a letter built from advice on forums asking for a POPLA appeals code.

 

I got nothing back until 2 days ago when I got a letter threatening court action unless I pay up.

 

Is there a statute of limitations with this? Is there an easy way of telling them they are too late or do I have to follow the process to continue to rebuff their claim?

SOL only applies if there is a debt. A PCN is not a debt unless its been to court and you have a judgement against you.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

PE have 6 years from the date of the cause of action to start proceedings. As you say you received no response to your appeal and request for a POPLA code then they are procedurally timed out to claim from you as keeper. If you can prove you sent a letter (copy on computer will suffice) then they will be pretty dumb to continue any claim as they will lose. however, good sense has never stopped them before so get a very strongly worded rebuttal sent to them and remind them that they are timed out and any claim will be robustly defended and all costs sought.
