I have an overdrAft with halifox which is in arrears.

 

Previously I sent a sar request and received a quite comprehensive sar.

 

It contained the previous 3 years statements, and screen info of the previous 3 years transactions. These seem to be the statements in 'raw' form.

 

I have crawled through the statements and found all the charges applied over the years. Unauthorised overdraft charges I think.

 

The account shows on my credit file as defaulted with arrears greater than the closing balance.

 

I have previously received letters from moorcroft about this account.

 

Now I receive only a yearly statement from halifox.

 

Can I reclaim the charges back to reduce the balance?

 

Thanks for looking and please help. I will never be able to pay this as it is. It's for over £3000 now.

you could try a BCOBS complaint if these are since nov 2009

to give you a figure of what its worth.

What route could i take next?

 

 

as i say nobody is chasi9ng me for this now. previously moorcraft were. I get a yearly statement now.

 

But it will have to be faced eventually.

" Halifax says the aim is to simplify its overdraft charging structure. Those in the red currently pay between 19.5% for an arranged overdraft, rising to 28.8% for an unarranged unauthorised overdraft.

 

There is a monthly unauthorised overdraft fee of £28, with a £35 charge each time a customer spends over their limit.

The new charges are £1 a day for each day in an arranged overdraft up to £2,500, £2 a day for arranged amounts over this and £5 a day for unarranged overdrafts."

glad to see you are all still here and helping people.

 

latest on this is it has been formally moved to lowel.

 

i got a letter recently which had a halifax letter and a lowel letter in the same envelope stating this.

 

i have done nothing with this, i just file the yearly statements i got on this from halifax.

 

i have the SAR still and have listed all the charges fro overdraft, which total approx £1000.

 

Will i just wait and see if lowel do next?

 

a few of my defaulted accounts are now with lowel. probobly worth about £4000 total now.
