Hi,

 

I have a quick question,

 

 

I am filing a claim for Breach of Contract using the N1 form,

 

 

I have selected

'I expect to recover over £25k' on the form,

 

 

instead of

 

 

'I am unable to predict how much i will recover' -

 

 

my question

 

 

- Which court fee do I pay?

 

 

As I don't know the amount of the claim?

 

 

nd is it best to put that I am unable to predict the value rather than 'over £25,000?

If you are looking to claim £25,000 or over then this will not be a small claim.

 

Claims valuing £15,000-£50,000 - court fees would be £610.00 issued via the court or £550 through MCOL. I think there is a higher fee if you don't know the value of your claim or if it is likely to be "unlimited"

Slightly off-topic but if you are bringing a claim for such a huge sum, are you sure that your case is watertight and that you have a clear cause of action and clear evidence to support it?

Also, are you sure that the defendant has assets which you can enforce against if you win? Are you ready to take the hit if you lose?

Have a read of http://hmctsformfinder.justice.gov.uk/HMCTS/GetLeaflet.do?court_leaflets_id=264 which sets out the current fees. Presumably this case would sit in the 15k - 50k bracket?

 

You probably know this already, but for a claim of this size you will have to pay your opponent's legal costs if you lose.
