Mr Mcall has already stated that he has signed a document confirming his acceptance of taking up the offer of MWA and being available and willing to accept a call from the Provider to discuss and consider same.

Any reservations he may have about accepting MWA should have been raised with the adviser at the interview where he agreed to the above.

What he appears to be asking now is advice on how to renege on or circumvent the agreement already made with the JCP adviser. He does not appear to want to take the advice offered that his best option now is to exercise his right to negotiate with the Provider and either turn down any offer made by them due to their inappropriateness or accept one on his terms. He can use his own personal circumstance to do this successfully if only he based his argument on what is acceptable as reasonable objections in the Guidance.

He can’t do that if he continues to refuse to accept the Provider’s call.

How he can so confidently assert the any placement offered will be ‘bull’ eludes me unless he knows something for a fact that he has so far not seen fit to divulge.

By refusing to do what he has signed up to do, which is so far merely to accept a Provider’s call to discuss MWA, he is assisting the Jobcentre in setting himself up for what he is desperately seeking to avoid, a sanction.

A claimant has the right to insist that he/she not be contacted by phone and give legitimate reasons why he/she insists on it. One does this before agreeing to be so contacted, not after.

Lapsed - I'm afraid I find your tone pompous, assuming and unhelpful. I'd be grateful if you could take your high-handed sneering to another thread please, and leave it to those who are offering constructive and non-judgmental advice. Thanks.

The reason I had to sign the MWA form was that refusal to sign would incur an immediate sanction. No ifs, no buts.

I am sorry that you find my comments objectionable and I can appreciate that they are not what you want to hear. That does not alter their factual veracity.

Every claimant is entitled by law to present a reasoned argument against signing anything. It is still an actionable offense to be made to sign anything under duress.

You have argued your case here but it is mostly subjective, therefore holds no credence. All I am suggesting is that you make your case to the appropriate authority objectively. No amount of weeping and wailing and gnashing of teeth make you right if you continue to act outside the law.

The fact that the DWP do it will not help you because unless you use their own laws and rules to thwart them you or I or anyone else do not have the power on our own to take on the full authority of the state.

This is what I'm talking about mate:

"If all the thanks that those who took the time and trouble to give you the benefit of their opinions and judgements is to throw it back in their faces then perhaps the pubs and the dens frequented by the criminal fraternity would be more suitable places to cater for your needs"

"No amount of weeping and wailing and gnashing of teeth make you right if you continue to act outside the law."

I'm not a criminal, nor do I see how I am "continuing" or have even started to act outside the law?

Anyway, to those who have offered advice, thanks, and just to let you know the letter arrived in mail this morning, checking my phone, Seetec appear to have not even tried to call, which means the adviser must've written up my objection as I asked. I've got to attend a [removed] camp about an hour on the train from me next Thursday. But, fingers crossed, I had an interview today for a paid job, (only minimum wage, zero hours, but hey-ho, a job's a job when it PAYS real money!)

I apologise if a couple of the many remarks I made offended your sensitivities, mate. I could have been more subtle but what I took to be your rebuff of the sound advice given to you by those who responded in good faith to your request for advice provoked me into responding as I did.

Now that you have explained that there was no need for anxiety over a call that did not exist after all I hope that you are able to rest easy.

Good news too about anticipated outcome of today’s job interview. Hope you have been successful and wish you best of luck.

That the job centre staff mislead is no surprise

They do threaten sanctions too easily and people do sign purely to avoid them

Could try using their complaints procedure

Some who reply don't try to empathise

Thanks Chester, but touch wood I think I've got a job now (find out tomorrow!) So, this whole MWA crapola can be avoided. If so, I'll then have to worry how I can survive for a month with no JSA till I get paid! But, one problem at the time for me at mo, cross that bridge when I come to it!! :)

Do check with your Local Authority if you qualify for housing benefit run on if you are claiming housing benefit.

Also you may want to check aorund for a local credit union or something that can offer short term help if you need it. Just say NO to payday loan companies
