ANPR LTD - Parking ticket

I received a parking ticket a week ago after my pay and display fell off my dashboard.

 

 

I appealed against it and sent them proof of payment

 

 

they wont accept it because I told them that as far as I remember it was still on the dashboard when I walked away.

 

 

I also explained it was gale force winds and my small car would of rocked with it

and thats when it must of fallen off but they arn't interested.

Its a PCN and I sent them the pay and display ticket I bought in the machine x

Just rang them up, its private and they said I dont have a case because my ticket wasn't displayed x

its an INVOICE for using private land and breaking some stupid condition of parking.

It was issued on Friday 21st November in Wallasey cherry tree centre car park

 

 

...Paid for my ticket and put it on the dashboard

it had started raining and gale force winds.

 

 

I Shut the door and looked to see if the wind had blown it off the dashboard

and it hadnt so I can only assume the winds rocked my car and it fell off.

I was honest with them and told them this.

 

 

I appealed on the same day and 7 days later (today)

I got a letter back from them saying 'it fell off again' along with there photographic evidence

all goes towards confirming the incident and actually weakened any argument you may of considered you had..

 

 

.it goes on to say that an amazing 97% unconsciously look back at their vehicle to see if the permit was actually still on display

when the door has been closed.

 

 

..in light of the above and they do sympathise but I still have to pay which is £50 if I pay within 14 days or £100 if I dont x

This is ANPR Ltd who are the village idiots of the private parking world.

 

 

Send a letter to them statingg what happened.

 

 

You will get a verbose letter back from them rejecting your appeal.

But they should include a POPLA code which you can use to appeal to an "independent" adjuicatore.

 

 

If you use the magic words "not a genuine pre-estimate of loss". you will win.

 

 

If they don't send you a POPLA code then you report them to the BPA.

 

 

This bunch of jokers have never done court and if you stand up to them they will slink away.

DBC .They have sent me POPLA code for me to appeal against their rejection,

 

 

but they also state that if I appeal it would progress any appeal and would nullify any discounts that remain

and should I lose may incur further costs x

Elaine - take note of what is being said to you, this is old hat and has been gone through a million times.

But there won't be any costs and they will never take you to court. It's all scare tactics. You just get down, submit your appeal to include genuine pre-estimate of loss and you will win.

Forget everything that ANPR says. You do not have to pay a single penny to these muppets. Follow the advice here and you're guaranteed to win, and cost ANPR money instead.

Most times ANPR don't even bother to submit any evidence to POPLA and the motorist wins by default. It's all a matter of who blinks first.

in the future never send any tickets you have purchased as proof of payment, just give them the ticket number.

the main point is that you paid ot park so anything else they claim is just an attwempt to get money out of you when it isnt due. You paid and displayed, just because their muppet couldnt see the ticket doesnt change the contract you entered into and they know it. they are relying on you being ignorant of the law and its accepted interpretations.

Did they give you as POPLA code when rejecting your appeal? I bet they havent.

What you do now is sit tight and see if they send you a notice to keeper through the post. This has to arrive between 29-56 days after the date of the parking event, outside of these times and it is in breach of the law that allows them to send it in the first place. When you get this NTK let us know and we will tell you what to say next.

Dont write to them, and its not a fine. They can say whatever they want, you will NOT be paying.

 

Please read the info you have been given, otherwise theres little point you asking for advice.

Do not contact ANPR again. Not by letter or phone.

 

You appealed to them, and they rejected that appeal.

 

You have to now use the independent appeals service POPLA as ANPR have given you a validation code.

 

The charge WILL get cancelled at POPLA with an appeal that demands a breakdown of the genuine pre estimate of

loss that the charge must represent.

Hello Elaine.

 

I can understand that it goes against the grain for you to ignore letters or not negotiate, I might have done before I was a member of CAG.

 

But the guys there know their stuff and will guide you through this. I can't remember the last time one of our members was forced to pay up after taking advice here.

 

You don't need to be scared, you're in good hands and the people writing to try and frighten you have no power.
