      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Several months ago

 

i received a letter from Idem saying black horse had sold my debt to them

at the same time i received a letter in the same envelope from Black horse confirming this,

Both letter stated that if i was on a scheme this would be honoured,

 

Black horse froze interest rates on my account in 2007 i was on a repayment only scheme,

i thought nothing untoward until

 

i received a letter from idem saying to ring them to set up a payment plan,

The amount owed differed from what i actually owed,

 

i rang them and they told me interest was being charged, i explained i was on an repayment only scheme.

 

They said they would write to Black horse,

 

i left it 3 weeks and contacted Black Horse they have not received any letter,

 

However they said they would pursue this and

made 2 telephone calls to them

 

i phoned Idem and they confirmed they had received the calls,

 

Now 2 months down the line and 5 letters latter to Idem ,

they have not replied or made any effort the honor the agreement with them or Black horse,

 

any ideas or help please both my wife and myself anr well into retirement age

and don't want the aggravation of these types

if BH has sold the debt to idem

then odds on there is something toxic about it.

 

 

tell us about the debt please - its history.

 

 

did BH get PPI or any others insurances out of you

[was it a loan or car finance?]

 

 

and I bet they've been charging arrears fee or late/over/letter fees

 

 

all of these are reclaimable.

 

 

if you had an arrangement with BH, idem are duty bound to keep it

 

 

as for re addin the interest again

that's a typical trick they use to inflate the debt

they CANNOT do that.

 

 

big tip: NEVER EVER TALK ON THE PHONE TO A FLEECING DCA

 

 

they ARE NOT BAILIFFS

 

 

and have

 

 

NO SUCH LEGAL POWERS.

 

 

if this debt if from pre 2007 odds on they wont have any paperwork to legally enforce it

 

 

send idem a CCA request.

I smell a cash cow account

 

 

most Ceder holdings were littered with PPI and other insurances

that you didn't need/want or even require

to get the loan.

 

 

LOTS of reclaiming to do if you can get the statements.

 

 

I bet you've not been getting those either?

do you have the original agreement?

 

virtually all Cedar Holdings secured loans at that time

 

were sold through brokers

 

with ppi attached

they've exceeded the 12+2 WORKING days deadline already

well after a long battle and many letters Idem (idiot-demensied-evokive-morons) finaly agreed that i was in a agreement with Black Horse and stopped charging interest , they sent a final response and a C/Q for £50.00 for the danages they caused me with unnessary phone calls. well this was not my fainal response , i sent a further 2 letter asking for my mony back and recieved no reply. by now i had paid the debt off i recieved a letter telling me my account was now satisfied and my requests for repayment would not be met. I then sent a legal letter (before court action) and recieves a letter from a director saying they were going to re-open the case (10 days ago) so all is not lost. i will go to court for £35.00 it would be well worth it just for the sake of it. If i win and they do not pay am i right i cannot use Balliffs or high court agents to collet as the amount claining is only £259.00

 

2 hours later

 

post man brings me a C/Q for £272.00 from the itiots so it pay with IDEM(idiot-demensied-evokive-morons) to keep writting
