Hi

 

I was hoping someone could help.

 

I was provided gas and electric by Scottish Power between July 2013- an 2014.

I left the premises in Jan 2014 and provided SP with my meter readings and new address in order to receive a final bill.

 

I have not received any correspondence since but have received a letter from Buchannan Wells and Clark

advising me to pay the o/s plus £70 additional fee which they have added on.

 

I spoke with BWC today and they have advised me they will enter a default unless I pay. I am happy to pay as I owe SP but not the additional fee.

 

I have called SP today who were extremely rude and helpful and said they would not recall the debt back, allowing me to pay.

 

I am now frightened I will receive a default, potentially from either parties.

 

Can someone please advise the best possible way forward?

ignore BCW and

NEVER EVER talk on the phone to a DCA or their 'fake/tame' solicitors.

 

 

they can do NOTHING TO TOU

they ARE NOT BAILIFFS

and have

NO SUCH LEGAL POWERS.

nor add ANYTHING to a 'debt'

 

 

deal with SP directly

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Thank you for the reply. But SP have refused to deal with me direct & told me to deal with BCW?

 

So , what would I do?

 

The default is impending. I want to pay but then don't want a default on my file once I've already settled the bill.

I called the ombudsman prior to your reply& they said to pay BCW as that's the only way to ensure I don't receive a default.

 

They said to state 'payment under duress' when I make payment.

 

I googled it & DCA can put a default on?

 

I'm sorry to ask again but I'm scared of this potential default.

a dca cannot default an account

they are not the 'owner'

what/if the owner does is upto them

prob already done it?

 

 

if want to pay them then go ahead

but id would deduct any fees added

they nor anyone are not entitled to add anything

to a debt that is a penalty

 

 

why can you not simply pay SP via the old DD details that you had and the account number?

Just pay SP. If you have their account details - Account Number and Sort Code then it is easy enough to pay them, remember to quote you SP account number on the payment so they can allocate it correctly.
