If they dont have the CCA, then dont pay. No paperwork = no money for them.

Can you give more info on the debt please?

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

If my advice helps you, click the star icon at the bottom of my post and feel free to say thanks

You shouldn't be paying a DCA a single penny. Especially if they havent got the paperwork needed to collect.

New Day are the wing of Santander that was created to administer all old store cards.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

that's ok

I though it was a spell checker mistake

but we must always be sure.

.........

new days cant find the CCA - that's rare.

the ball in now it your court

BUT the debt MUST be marked SETTLED not Partial settlement

else any debt with that down

it leaves the rest open to be chased as soon a they sell the debt on

yes in the library tab top left

just make sure you relate to the fact they hold no enforceable agreement

and the debt MUST be marked SETTLED

not Partial settlement

else its a total waste of the money

the fact that they hld no cca sadly does little to help you.

they could still default you

and that would kill your file for 6yrs probably.

so what do you think I should do

Any suggestion

If you are intending to leave the country anyway, and they dont hold the CCA, AND they arent the OC, why even bother worrying.

Therefore you are saying that they would accept my low offer to settle the debts if there is no CCA and leave me alone

I am a propety owner and going to let my place out and go abroad to work

but before that I would like to settle with all of my creditors and

do not care for my credit rating I just want them to leave me alone

what is the best way to do it any suggestion

if your creditors are informed you are moving abroad

then they'd be a bit stupid to serve a claimform/CCJ

valid in the UK but nowhere else

when they know your are out of the country.

Thank you for the information

How about a settlement of 30 t0 35% do you think they will leave me alone or go away for good

now I am thinking to offer New Day £200 from a total debts £635 outstanding marked as behind with payment

and this IS the lowest one of my cards and the rest of cards owing are all over £10000 each and there are few of them therefore I am testing this one first to see the result.

please any suggestion any advise

If you offer a settlement, then you have to make sure that you use specific wording. If you don't then there is absolutely no point of offering it.
