      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Check out the first para of post 5 HERE. Thats Banks for you. They could start by telling the truth, and gaining some morality - and stop extracting food from the underprivileged in any way shape or form to rake in thier obese profits. Make a stand against what? Justice? Morality? or something ruthless to keep the fatcats happy.

1 st letter recieved.....Woolwich have "investigated my request for a list of refunds against charges made "" "and advise any refunds will be on your statements, if you require the last six years statements there is a fee of £10" Blah de Blah!! with the LBA due tommorow, should I send a SAR letter and a £10 postal order, hold on the LBA till 6 months of statements arrive (need to check if LBA requires amount claimed)

 

or send LBA and ensure figure on MCOL is correct having recieved statements by then and deducted charges refunded, and then added rececent charges onto figure (about 240 pounds at the mo)??

 

2 nd letter received "thanks for bringing matter to our attention" " in view of the complex nature etc..... sent to Barclays...........E14 5HP

OK I have now recieved their aknowledgement to my SAR

 

Also recieved an Immediate Action Required letter from the Woolwich "account balance outside of any agreement with the Woolwich"

 

"return to its authorised limit within 5 days"

 

"whilst account is in breach of agreement you will be charged interest AND a daily fee of £3 for each day, until such time an offer of repayment from you is accepted"

 

All of the figure that I am over my O / D by is wholly made up of Interest, Unpaid DD Charges and a Forced cheque charge.

 

Can I get them to put a hold on my account to stop any further charges on this account?

Try not to worry Delboy you can claim them back as well. I take it the overlimit charge has come about due to their penalties.Have you opened a parachute account yet?

Yep the charges have taken it over nothing else and I will claim them back as long as it doesnt take me over the £5000 small claims limit I am at well over £4000 at the moment.

 

Have you in your readings seen anything about getting the Wool to suspend the account and further charges whilst I take them to court ?? :)

 

And yes I have a parachute account.

As to woolwich suspending the account i have read, nothing!

I think if they can suspend your account if you ask but they will notify the CRA's and you will get a nasty little black mark on your file.

you could write to them and explain as you consider the account to now be in dispute in relation to their charges could they suspend any further action on the account they will probably sent back ' please find enclosed a copy of or T&C's that you agreeded to abide to when you opened the account.

The only other thing to do is pay off enough to keep below the level where they start apply charges.

And dont worry to much about going over £5000 till you get all your statements and you have a firm figure and then we can help formulate your next move.

OK I have received a list of charges (not Statements) against my account, (same as before, but now more up to date :( ). Nothing received about which charges were subsequently refunded which Is what I wanted so my figures would be correct for LBA. Do I have to send A letter to The Woolys to obtain this figure or what? The SAR doesnt ask them to detail this?

 

Please refresh my memory as to what I can and cant claim back?

Hi Delboy take a look at my thread- Action at last! I'm having the same problem as you and have recieved lots of advice. Put it in writing to them that you request details of returned charges and they have not included these details. As part of your SAR this info should have been included land let them know that. I think I shall do the information commissioner and letter to woolys at the same time re refunds and telling them I am writing to the Commissioner

Delboy send off your LBA and a letter to the Information Commissioner.

You have given the Woolwich enough time to supply what you want. IF and thats a big if, it gets to court, let the woolwich explain to the judge why they failed to supply you with the data you need to complete your claim.

If you have a figure put that in your LBA, also put in the letter that when your statements arrive if there are more charges to add these will be added when filing at court and you will send them an amended shedule.

I think your right an adjustment on the SAR template may be in order just to stop those weasels getting away with delaying our claims! I'll keep an eye on your thread with interest since we're both in the same boat, good luck mate. CC

Hmmn going thro the NEW Schedule of charges they have sent me, they have kindly totalled up my charges for me. The total doesnt compare favourably to the first schedule of charges they sent me even tho its a more up to date schedule.......... I have noticed on the new schedule that there arnt any ICcharges on there.. strange, why have they not included those, those are for interest charged arnt they.. perhaps not included deliberately???

 

Oh and why isnt my signature showing ??? (but is on post 66)
