    • I have a problem, a serious one. On mid November 2023 my boiler (installed 10/21) failed and flagged up the code 29.10: blocked flue. The EB engineer came out and replaced the fan, said it was unusual, put it down to storms. On 16/12/23 the same thing happened. Another WB engineer came 18/12/23 and fixed it, but said it isn't the boiler, it is the flue, and that he would mend it this time under the guarantee but they would not do that again if it failed unless I got the installers to reinstal it. On 27/12 it failed again. 29.10. I did not call them because of their saying I would have to pay. I contacted the installers who responded, then stopped when they saw the WB report of 18/12. By February I had had no central heating or hot water since Christmas, so I posted a job for a heating engineer to give an opinion on the flue installation. He found the flue blocked with vegetation from the trees my neighbour planted near the wall, and which I have been desperate to get uprooted. He gave a report and photos, and agreed the flue needed reinstalling. I got nothing from the original installers, so I contacted the Gas Safe Register. They sent an inspector, who gave a full report and had the original installers down and they reinstalled the flue as instructed, and notified LA Building Regulations.   On Friday I received a certificate from the Gas Register saying the reinstallation of the flue had  been carried out by a registered heating engineer.  It was from the installers, and the certificate does say that it is 'not conclusive evidence' and they had notified the local authority Building Regulations on my behalf.  As I only received it Friday, I have not yet pursued it. On Thursday, as the installers said they had reinstalled and there was nothing wrong with the flue installation, and that the boiler was not working, I wrote to WB and asked them to come and repair the boiler.   During all this time I have been in contact with various people, including Citizens Advice.  I had hoped they would refer it to the Trading Standards because you cannot contact Trading Standards yourself.  I am hoping they will.  I have other serious issues to deal with.  I don't think elderly people are helped as much as they should be.   I had an email from them Friday - yesterday - demanding I deposit £200 with them before they come down to repair it. I told them I query that, and said I will consult on my consumer rights, sending copies of that to all concerned. This is their response: Thank you for your email. The £200.00 is reserved to ensure the work has been completed correctly – in the case where remedial work has been resolved, no charge will be taken. This is due to the amount of calls we have reattended in the past where remedial work has been said to have been completed but hasn’t been. If the issues detailed in the report from our previous visit have been issued, the money will not process and will simply go from reserved back to the customers account without ever leaving it. Under our Terms and Conditions: 6.1 Assignment and Subcontracting. We may at any time and without any notice to you assign, transfer, charge, subcontract or deal in any other manner with all or any of our rights or obligations under these Terms. You may only transfer your rights or your obligations under these Terms to another person with our prior written consent, which we will not unreasonably withhold or delay. Please refer to our website for full terms and conditions." Can they demand the money up front like this?   It is a week's state pension.  Would anyone give a whole week's pay for something which should be under guarantee?  I can copy and paste the various reports I have had from Worcester Bosch, including the one of 10/2021 when it was installed and failed 24 hours later.  The boiler worked until November 2023.  Also, I cannot understand the terms and conditions, because the boiler was given under the ECO3 scheme.  I have been on disability benefit - DLA - since 1992 and I don't remember signing anything with Worcester Bosch.  I am not sure if I am allowed to attach all the correspondence here.  It will take time, because the page keeps being unresponsive and I have to keep clicking 'wait'

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Im trying to help someone sort their debts out but

 

 

at the moment the creditors are refusing their offer and wont send a standing order form,

 

 

ive helped them provide an income and expenditure form and theyve sent it to them along with proposed payment.

 

They are now asking for proof of income and bank statements

- im just wondering if they are allowed to insist on this or should i just advise to start making the payments by cheque or standing order

(details of their bank account and standing order are on the payment slips - they could use that?)

 

 

and write to them again asking them to reconsider?

 

 

They dont like the idea of someone getting a look at their private finances like bank statements and wage slips even though everything is done truthfully.

 

They keep ringing at work so ive advised them to put in writing that that must stop and all communication kept in writing.

 

The creditors are capital one and everyday loans.

 

The person lives at home with parents and works but has found to be in debt due to silly financial control when younger,

they have no possessions but are buying a car on monthly terms.

They have a mobile phone contact which is no where near the end as of yet.

The only ones that should see full I&E's would be priority debts such as mortgage or secured loans on property. For credit cards, basic loans etc, they can see a very basic budget summary along with your proposal of payment. Nothing else. No bank statements, no payslips, no contacting employers etc.

 

If they dont like it, then tell them you are dropping them to £1 a month for the life of the debt as they arent doing anything to help you.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

thank you so much for your reply, so, you would advise that i advise they write back and again make the offer again but state they know they dont have any rights to see bank statements, etc - how would i word this please? thanks

Try this:

I am prepared to offer £x.xx per month for a period of Y months to settle this debt.

 

I am under no legal or moral obligation to provide wage slips or bank statements. Should you continue to demand these documents, the above offer will be withdrawn with immediate effect and substituted with a token offer of £1.00 per month.

 

Note: Any attempt to make contact by telephone either at home or at work will be construed as harassment and willbe reported to the relevant authorities. All further communications must be made in writing only.

- what do you think are the chances of this being taken through the courts?

if that happens would they take the car away even though it is being paid on hp?

 

 

of course the person im helping has been silly but have held their hands up and are sorting it out now with my help

- i only became aware of this after they broke down and told me they were feeling very suicidal,

 

 

i told them i would help them out and not to beat themselves up,

theyve been stupid yes but they can sort it out...

 

 

.. the payments they are able to afford are £10 a month but could get more in about 3 months when their wages go up,

they would not still be in a position to pay the full amount

- £150 month for one and £290 for the other but maybe £50 a month...

..... not going to pay them off anytime soon but at least they will be trying....

 

 

.... or do you think i would be better advising them to talk to stepchange instead and let them help them out?

yes, thats true - i do wish they would stop dishing out loans without really looking if the person can afford it....... but, its been done and rather than hide in the sand and ignoring it im helping to sort it out for them, luckily it was only the two loans but ive heard of others who have got loads and there is absolutely no chance of ever paying the money back

The Creditor has no legal right to demand the information asked for, if your friend has signed the I&E with a statement of truth it should be more than acceptable. Sadly, Capone are one of the worst to deal with.

 

If they become stubborn, speak with National Debtline - ask them to help your friend complete a Common Financial Statement (I&E) and then provide that to creditors.. it is my understanding they cannot refuse to accept this.

. i will help them write to them offering one last time and if they still wont accept

 

 

i will get on to national debtline for them,

 

 

i do think firms like this tend to prey on the young and naive or the vulnerable who cannot sort things like this for themselves,

 

 

if this person hadntve told me i dread to think what would happen but thank god they did. thanks for all your help

Could just download the budget summary from ND. If its good enough for the courts, its more than good enough for capone.

and looked for PPI & Penalty charges?

 

 

pers I don't ever recommend trying to neg with them.

well, it seems her finances are actually in a worse state than she said,

 

 

i went with her to her home to get these bills and to show her how to set up a standing order but

 

 

there she pulled all sorts of paperwork out and it really is quite a mess some of the loans and cards she has got..........

 

 

i really do hate how vulnerable people are left to get in this mess..........

 

 

on looking at her things she owes over £12,000 to 9 different cards and loans and one catalogue..........

 

 

im thinking now the best thing for her is to apply for a dmp with stepchange?

 

 

I really feel for her now because shes been getting lots of calls and post to do with these debts

and is just shoving them in her box and hoping they go away.......

 

 

time to bring money management into schools i think.....

No matter how bad the finances are, or how bad the debt is, it can be sorted. You just have to be strong willed and be prepared to play hardball with creditors.

 

Can you post details of all debts she had with as much info as possible? Create a new thread for each type of debt she has. For loans/credit cards, there are all sorts of things to check such as insurances/charges/correct paperwork etc.

 

The more info you can give, the easier and more likely it is that all these debts can be reduced. Just remember the golden rule. Just because a creditor/DCA says you owe an amount, does not mean you do.

thank you - im currently going through her things at the moment and will write it all down and then start a new thread, luckily she does work but doesnt have any family as such to help her out with these situations - i met her through work myself and have become something of a confidante to her......

Going back to post 1#.

Creditors not providing SO forms, there are templates available online free to download, if you have the creditors bank details it is possible to take control and make payments at an affordable, (which can be useful if a creditor goes for litigation).

 

 

I agree with dx CCA all the creditors before doing anything about payments.

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.
