I also was in the middle of a dispute and they have sold it to cabot they say. They can't do this!!

 

When are they going to be dealt with?

 

I have refused to deal with cabot. If we all did the same!??

 

Can they pass an account on during a major complaint?

If the account is in dispute, they shouldnt sell it. I'd also question paying welcome finance for years. Have you reclaimed all insurances they charged you and all unlawful penalty charges? Almost every single loan is chock full of them.

Hi.

Have got the SAR. Just arrived Friday.

 

 

What am I looking for exactly?

 

 

Can I really claim money back?

 

 

On what grounds can I do this?

 

 

As regards the CCA there is a copy of some sort in the SAR so what can I do with this too?

 

 

I'm going to write back and tell welcome about not selling whilst in dispute.

 

 

Are there any letters on here I can use for this specific point?

Get the CCA sent to cabot. Welcome rarely had good paperwork due to their inept admin systems and cabot very rarely ever have the correct paperwork to collect the debt.

All you do is send the CCA request letter along with the statutory fee.

 

You do nothing else at all until you receive their response.

 

If welcome have sold the debt to cabot, then cabot own it and you need to deal with them.

Welcome will say they have washed their hands of it, and then ignore you.

 

I would not ignore cabot as they are known to issue court proceedings if they think they have a gullible person

or a debt that would be a default judgement.

They will then try other methods of collection through the courts.

 

A CCA request will attempt to put a stop to that.

I have seen a photocopy of the agreement in the SAR

 

So cabot will have it too

 

Had car loan but i paid that off

 

No change of address?

What difference would that make?

 

I would be entitled to see the deed of sale.

 

 

So I will ask for that too.

 

Though they stAte welcome has passed my account not sold it

When did you take out this loan?

A CCA before april 2007 has to be a copy of the original plus terms and conditions at inception plus any changes until the account was closed.

it is VERY rare welcome have that info,

it will likely be even rarer for cabot to be able to get that.

 

They might try a reconsituted agreement with a dodgy photocopy of random stuff hoping you believe them.

Do NOT ever think that a DCA will ever be able to get something.

Force them to prove it, otherwise, like i said, you mark yourself as 100% gullible and they will chase you.

 

You also are NOT entitled to see any deed of sale. That is a private commercial document.

 

You say cabot is acting on behalf of welcome? If that is so, then ignore them completely. They cannot do anything in that case.

 

Can you post up the letter cabot sent, minus any personal info?

More like they laugh at you and go to their friends " here, have a play around with this debtor.

 

 

They think FOTL actually works". Then they take you to court and a judge rule sin their favour as you try and defend yourself with a bunch of FOTL crap.
