      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Payday lender Wonga said it would write off the debts of 330,000 customers whose loans would not have been approved under new affordability guidelines.

 

 

 

 

 

Sky sources said the cost of writing off the debt will be £35m.

 

There is £220m debt outstanding for the customers affected, at an average loan value of £667.

 

The short-term lender said it would contact the borrowers by 10 October.

 

City watchdog the Financial Conduct Authority (FCA) said the 330,000 customers who are currently in excess of 30 days in arrears will have the balance of their loan written off and therefore owe Wonga nothing.

iIf they are writing them off will they remove the foot print on these peoples credit file?

Took few short term loans from Wonga 2 years ago, repaid them each time except the last one ( due to other loan repayment commitments ), when things got bad, I have heard nothing from the company with respect this money, not even a letter saying money owed, it does show on credit report.. 3 months ago I moved, since I was loaned money on top of my currant level of debt, I might fall into this good news today, which was 21k at the time, now a lot lower as on plan, Question I ask if I haven't heard from this company in two years, and now I have moved, how will people who have used this company know the debt has been written off if they have moved or are in similar position.... I know this news has only broken today, but thought I would ask anyway.... Wonga is the only company that hasn't contacted me with respect my debts, which I thought been strange, so have concentrated on the ones that have....and have been in fair affordable monthly plan now to clear currant debts... I'm sure other people will be asking loads of questions on this matter, so will keep my eye out....

No, am concentrating clearing my other debts that I have been paying since 2011, when I put my self debt plan in place, I wrote to all companies I owed, all replied except Wonga, so I left them of my plan.... made no further contact with them, last contact was in 2011 with them....

The [public] notice doesn't prescribe which accounts are to be written off http://www.fca.org.uk/your-fca/documents/requirement-notices/wonga-group-oct-limited-vreq

 

From what I understand of the matter, the crux of the original investigation was the issue of multiple rollovers, the cynic in me might suggest that the majority of affected [aged] accounts are those that have previously repaid a large percentage of the principal borrowed with little loss to Wonga with the exception of its hyper inflated fees & interest.

Well, despite the site telling me "Your current trust rating means you can apply for up to £1,000", my request to borrow £50 was declined. I guess they are not lending anything out to anyone, for fear of having their bottoms spanked! :rolleyes:

I wonder if this will affect me. Had loans around 2009-10 where I paid the full amount and then borrowed more and more month on month to live as I was paying my full incoming funds to clear the loan. In the end defaulted and was sent on to their pet debt collector.

This doesn't seem to be very well publicised...53% drop in profits - the Wonga Way seems to have fallen into a very murky black hole!

It wrote down circa £19 million against 2013 accounts to cover its costs for this Junes kerfuffle, would imagine its just being tax efficient.

Common sense says they will since if the loan has been written off in its entirety then no monies are owing to Wonga and there can be no arrears.

 

Does anyone have a definitive answer?

This doesn't appear to have been addressed. I think they will argue that an account was taken out regardless of whether it should have or not. If they mark the records as the account is cleared they might consider that to be satisfactory and responsible reporting.
