Hello,

 

I'm new on this forum so welcome all users :).

 

 

I have some problems with Gold's Gym.

 

 

Me and my wife was on 12 month contract with Gold's Gym and

 

 

after finish of contract we cancel membership.

 

 

I spoke with the gym, but they told me that they need to charge for extra one month for nothing

of course just because I call to late in their opinion.

 

 

I didn't want to pay as I don't even use gym from 6 months as we have a baby

and just pay it to not have problem with cancel chargers,

but want to cancel it immediately after.

 

 

I cancel direct debit and forget about it,

 

 

but now some bailiffs send me and my wife letters that from 2x£35 monthly pay they wont from me 2x£167!

 

Company called Credit Resolutions Services (CRS)

 

 

send me a letter that if I will not pay it or make dispute

 

 

or they will register CCJ against me.

 

 

My wife have same letter.

 

 

Should I worried or ignore it?

 

 

They also calling me and texting.

 

 

I don't know what to do :-x

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

Can I do something if they make some calls for my mobile?

They calling from very "exotic" numbers and some recorded massage telling me to wait as they connect me with consultant.

This is very annoying.

Hi Woytas,

 

Above you say "bailiffs" but I assume you mean a DCA like CRS. Please confirm.

 

Any admin charges they add as should be denied as they are unlawful penalties. We'll help you with this.

 

If you wanted to cancel the m/ship agreement, you should have given the gym a full month's notice during the eleventh month of the m/ship, or any time after that.

 

Whether you used the gym or not, you are still obliged to give the notice and pay a final month's fee.

 

Let us know :-

 

1. When the DD was taken each month.

 

2. When you told the gym you wanted to cancel.

 

We can help you with a letter offering to pay the final month's fee if, and when, the gym agree to accept this in settlement of all that you owe.

Ok. I think they are not bailiffs as @dx100uk confirmed, they DCA as I suspect.

 

 

To be honest I don't remember all of this, but

 

 

I think when I call them they mention about 1 extra charge for month.

 

 

I remember I call them few days after DD was taken from my account for a month, so

 

 

I feel they just want to take unfairly 1 month extra.

 

 

For now I don't care and I can pay this to avoid more stupid letters and phone calls.

 

 

Should I go to gym and ask them if I can pay those £70 for peace of mind

or I need to deal with this people Credit Resolutions Services (CRS)?

 

 

@dx100uk advise me to ignore it.

Hi Woytas,

 

Avoid all phone contact with the gym and CRS and keep everything in writing only.

 

If you ignore CRS, they'll continue to hassle you. If you try to pay the gym or CRS, they'll take your money and then come back saying you owe more for their Admin Fees. You need to try and deal with this properly or it could go on for many months.

 

Can you answer my Q's 1 and 2 above ?

@slick132 I thought I was answer it, but to be clear:

 

1. When the DD was taken each month. - Sorry I don't remember as it was 6 months ago and I cancel it in bank, so don't have any records

 

2. When you told the gym you wanted to cancel. - This was after 12 month contract expired and I pay last contracted fee, but don't remember details - sorry

 

 

If they powerless I don't worry about what they sending and will block all call from them. I feel I pay to gym more then they deserve as I don't attend gym for 6 month due to newborn.

 

All of this stupid gym contracts are so unfair and will never go for any new one. Stupid politics of gyms will do that not many people will want to use them. In USA you pay 20-30 bucks for much better gyms without any contract and you pay as you go - I don't get it what's wrong with UK gyms, as they don't offer anything special but want to create customer trap and loose potential customers forever.

Hi Woytas,

 

Best way to settle this is to offer to make the final payment, now that you realise you should have paid for the month's notice period.

 

You have to give notice and pay this, regardless of whether you used the gym or not.

 

Can you check your bank statements to see when the DD was taken each month.

 

Can you also ask the bank when you cancelled the DD mandate.

 

When you know these dates, we can check to see if you gave notice to cancel during the 11th month or later. That will dictate whether you need to offer the gym a final payment of £35 each from you and YW.

At this early stage, it is not good to ignore the gym's demands but do not speak to them at all. Keep everything in writing only.
