    • I would have thought so but I'm no lawyer. What did the one that you spoke to say? You could also google about how/when a will trust is set up to get more of an idea before you speak to the original lawyer. HB
    • While I am waiting for the original solicitor to ring back about the will can I ask. After my dad passed they were informed about this an released a copy of the will to me and my brother, should they have set the trust up then as they were informed of his passing?   Thanks again

The MP, who is one of Rishi Sunak’s trade envoys, is also said to have called his 78-year-old former campaign manager at 3.15am one day in December, claiming he was locked in a flat and needed £5,000 as a matter of “life and death”.   Hes supposed to use funding from Taxpayers and doners for a life of service, not funding a life of drink and debauchery Hope his parliamentary expenses are also investigated.   In fact, perhaps Mr Bates next role in life should be as an independent investigator of Parliamentary expenses?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My crisis is as follows,

 

 

I have two credit cards with two different companies, Vanquis and Barclays.

 

Vanquis has gone over limit and now got a debt collection agency sending me letters.£3000+, of which I have been unable to pay since August.

 

Barclays has just applied late charges and will soon most likely be the same as Vanquis. £5,900+,

I haven't contacted them yet, as I know they will proberly reject my offer as vanquis has.

 

I offered vanquis £10 per month because I'm about to move into shared accommodation as my relationship fell apart after 7 years,

she now has a brain tumour after battling Skin cancer.

 

 

Obviously this has nothing to do with debt but it also shows that when banks are told your personal issues

they just say you need to contact a consolidation company.

 

I have been told there is paper work that I need to send both companies,

one that can request the debt be written off because my financial situation has no sign of improving and will never be paid off.

 

 

And also another more likely option for me,

is to make an offical realistic offer that I'm happy with, like the £10 per month

and they'd have to accept it or take me to court,

in which case I would still be in the same if not worse financial situation as a result.

 

I'm losing sleep because I don't know what to do or how to actually get out of this nightmare I've got myself into trying to have a better life.

 

I've lernt my lesson, but I still pay tax, I'm selling my car and moving into a crap hole to try and pay off my debts,

I just need breathing space to do it, not be tied to a penny pinched budget that the courts say I should be living because a consolidation firm says so?

 

Am I crazy to think theres no way out?

 

Any advice would be very appreciated, Thanks for your time people.

in the mean have a read around similar threads etc,

 

 

including the blogs etc re dealing with debt.

 

first thing though, try not to lose any sleep. they are not priority,

 

 

and can be dealt with. including any dca harassment.

 

charges could be claimed back. any missold ppi to claim back?

 

ps, it is wrong for them to tell you must go to a dmc.

 

 

you are entitled to do things yourself,

 

 

and they must accept such and take into account financial difficulties etc

god please don't go with fee paying debt management companies

 

 

they fleece you blind.

 

 

quite honestly the cards and all NON priority debts come VERY LAST

 

 

don't make radical life changes to pay off non priority debts.

 

 

no-one can do anything to you - they cant get blood out of a stone

 

 

its YOUR MONEY you CONTROL IT.

 

 

you TELL THEM WHAT THEY ARE GOING TO GET.

 

 

TELL [dont ask] them they are only going to get £xxPCM for xx mts

as a goodwill gesture

and as a reciprocal GOGW they must freeze int & refrain from levying PENALTY charges.

if they wont

drop them to £1PCM for life.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I've had the cards for about 3-5 years Vanquis and 2 years barclays. I don't have all if any statements because I chose paperless and never kept the emails. I surpose my online access will show passed statements?

"People" in general are still not aware of their rights when it comes to unsecured credit such as credit/store cards/ catalogue debts

PPI to reclaim + penalty charges?
