      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

 

I have recently moved into a property and the first correspondence I received from TVL was a letter stating I have not responded to "previous letters".

 

The letter states that I must keep the letter and take it into court and a guide to "what to expect in court"

 

This is all rather harsh and pressure, what are my legal obligations to buy a TV licence? What do/say I do if they come to my home?

What type of letter. Is there any history to it?

Standard part of their threat chain.

It does not say they are taking you to court.

Rather, what happens "if".

 

 

The letter is pure lunacy and drivel.

I think I've received it four times in last year followed, 28 days later, by one which, if I remember correctly, is headed something like "The Enforcement Process". And many more besides.

 

You will most likely be graced with a visit soon.

Tell the idiot to leave.

If it refuses, call the police.

Don't talk to it.

Certainly don't give it your name.

It will have travelled at its own expense and not be very pleased.

Tough.

 

The "legal" requirements for a licence are broadly as stated on the letter.

If you don't buy a licence or tell them you don't need one

- stating why

- they will continue to write every 28 days until long after your death.

 

Is your real name The Legal Occupier? If not, they cannot take you to court.

 

The BBC has to be funded but the way they, with Capita, operate TV Licensing is a government-endorsed scandal.

Next ThreatOgram in the chain will be the This Address is Under Investigation one saying that a TVL Crapita goon will soon be calling. You don't have to let them in, talk to them or otherwise engage.

Exactly has Brassnecked says, you do not have to let them in, talk to them or otherwise.

 

If anyone turned up at your address asking for your Name and to be let in to inspect your kitchen to see how many toasters you have, Would you let them in?

Exactly, therefore tell the idiot from Capita your name is "The Legal Occupier" & to get off of your Property.

 

The next letter in the chain you should see is "We have opened up an investigation"

I just moved in a few months ago and this is the first letter I received.......Addressed to "the legal occupier"

 

You could do the same as one individual I know does with letters of this type - Scribble on the envelope "Return to sender. Person unknown at this address"....

What do/say I do if they come to my home?

 

There are four threat letters the BBC use, and they are spat out and printed by their threatogramme computer.

 

It matters not one jot if you don't need aTVL, & lets face it nowadays no-one needs one, every month they will send you a very puerile tame threat

claiming an investigation has now been opened, what to expect in court, what you need to know about the enforcement process, blah blah blah, yawn yawn yawn...

 

If it is addressed to the occupier then technically you have won, the ONLY way they can get any info out of you now, is if you tell them.

If a random stranger feels they can approach your property and knock your door, not only do they have no legal powers to be demanding info from you,

but they can be told to foxtrot oscar, no personal details, no name, no acknowledgement and shut the door.

 

You are under NO legal obligation to pay the TV tax, you won't go to court unless you convict yourself by signing the admission of guilt form (TVL178)

This is the only way they can get a conviction, plus all of the TVL (cra@pita) goons are paid commission, once you know who they are tell them to do one and shut the door.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Yes follow this!! Never let in your home or sign anything and do not give them your name and details. The TVL178 is an admission of guilt and if signed will land u in court.

 

No contact, no contract. Golden rule.

 

Lets not get into the whole contract thing. Simply dont contact them and just ignore if they do come

I like to play with them though, mess with their heads and waste lots of their time. At the end of it, they still walk away empty headed, oops, I mean handed and without any commission.

 

 

The last one I had come to the door started running through all his questions, until he got to the one that said "Do you have a television in the house?" I replied, no, I don't have "A" television, I have 5 televisions. You should've seen his eyes light up as he thought he'd made a kill!

 

He then cautioned me, and carried on asking his questions, all of which I answered by saying "no comment". He was writing all of this down. At the end, after about 20 minutes, he asked me to sign his form, so I said "I don't think so, but I do have something for you", I then handed him a bundle of unopened letters from Crapita/TVL/BBC, told him to do one and shut the door.

 

It gave me a good 20 minutes of free entertainment lol.gif

They could get your name off the electoral role, but before they can take you to court, they would need evidence or a signed confession from yourself.

 

Now.... One question:

 

Do you have a television or computer/laptop/ipad/phone that you watch live TV broadcasts on ?

 

If the answer is "yes" then you should have a TV licence.

Its the usual endless crap they send out, they go in cycles, we may investigate, we will, we are going to, etc... Mine are addressed to The Legal Occupier which is meaningless and has no legal basis.

Regardless, ''IF'' or where they get your name from, it matters not one jot.

 

You won't get a summons.

 

They need to obtain 'strict' proof before they can get a judge to issue a summons.

 

Ignore them, you are miles away from any court summons.

It so stressful, some of us can just about put food in our mouth and pay hiking fuel prices without this cost too! :(

 

I think you'll find fuel prices have plummeted in recent months. Just to be a little more pedantic, WHAT costs? Ignoring these idiots costs nothing.
