Oh mighty forum!

 

I have acquired a CCJ against a debtor ( I wont bore you with the details). The debtor refuses to pay because I have not used their full business name, having missed out a part of their company title. How can i enforce this debt as they refuse to pay.

You have a Judgement Order, so a judge has accepted that the defendant is liable for the debt?

 

 

What order was made for payment " forthwith" or within a set time scale?

How much is the judgement for?

Did they defend the claim? If they did and they did not use the name being incorrect at the time then they would be hard pressed to do so.

 

Would OP now instruct HCEO to collect. Its up to Defendent to request a set aside on the grounds of incorrect name.

yes to vary, as the company has changed its name since ccj!

 

any idea how i go about doing this brigadier ?

Visit your local court, the staff will provide you with the appropriate forms (the court staff cannot give legal advice but will assist). Court Office hours are mostly restricted to 1000hrs to 1400hrs. due to cost cutting.

here is what they have written back to me saying

 

it is ordered that

the district jude intends to deal with the application by written representations as follows

 

the respondent to the application shall file with the court and serve written representations by 4.00 pm etc etc

 

so if anyone knows - what do i do next

 

i put in my n22 stating the company has a name change however i am not sure of this next step as its a new one to me
