fair enough :-)

 

so they can't force me to make monthly payments as there was nothing ordered by the court? but obviously when we sell they get their money then?

 

One more question should interest be frozen, because I'm sure the amount has changed each time someone write to me, I am going to dig though my paper work and double check but is that right?

shouldn't of been paying anything from day one

there was no order by the judge to do so.

 

 

interest cannot be added at all unless it was specifically mentioned in the CCJ judgement box

I would guess this was a forthwith judgement and they went directly for an ICO

[NOT a full charging order..speaks volumes]

 

 

was the home solely in your name as was the loan?

well they'd have a very hard time in getting a full order after all these years.

and if any of those payments you've made have ever gotten thru to NatWest...

 

 

ever sent NatWest an sar?

get all the statements etc etc

might be worth it

you never know what charges insurances etc they spoofed on you...

 

 

could severally dent the sum owing...

urm it says final charging order

but your LR entry says ICO?

 

 

go have a dig around for any paperwork you can find

like the original claimform or the CCJ

or the order of judgement and get those up can you

?

Yes I know - I thought that was weird too, and I downloaded my land reg document recently too so something isn't right.

 

I will have a dig through my stuff - might take me a while!

The creditor doesn't need to register the full CO the ICO is sufficient to register their interest.

 

 

They could but it would just cost money for no gain - so they don't.

 

 

Lots of people sadly but understandably look at their LR records and think ah they've made a cock up and not "finished off" for want of a better phrase the charging order.

 

However when you think of it dispassionately it does make sense.

 

 

At the final charge hearing there are two choices

1) A full charging order is granted or

2) the interim order is dismissed.

 

 

If it's the latter the LR entry will disappear, if it's the former it continues and the ICO registered at the LR stands.

 

An ICO is done to stop the debtor selling quickly (allows the fleecing companies to get their grubby hands on your house on what probably came from an unsecured debt in the first place).

 

 

If the entry at the LR (from the ICO) is present years later the only assumption can be (for the reasons above) is that the full CO was granted.

CPR part 73.10A(3) covers it.

 

"(3) At the hearing the court may— (a) make a final charging order confirming that the charge imposed by the interim charging order continues, with or without modification;

(b) discharge the interim charging order and dismiss the application;"

I would resume your payments to the CCJ otherwise they may apply for an Order for Forced Sale of your property...the Charging Order is irrelevant at this stage in your problem...its a County Court Judgment that you need to deal with and resume payments as per the initial judgment.

" Got a problem with Shakespeare Putsman.Had a loan with Natwesticon around £30k.

stopped paying and account defaulted in August 2008.

Shakespeares took us to court and got a charging order, (after they got Judgment CCJ) (i cannot remember excatly when) we made arrangements started at around £100 which we mainatined for quite a while then we wrotea and asked for a reductions gradually and our last amounts was £20 per month.

Last payment was in May, I have had so much going on in recent months, that I had to use every penny I could,"

 

So obviously aware of the CCJ and making regular payments.
