Well i have some news. After sending off the CPR & CCA requests i have today received a letter from Weightmans the solicitors representing Cabot in this claim.

 

It reads as follows.

 

We write to confirm that our client has advised us to discontinue the proceedings.

 

We confirm that we have today filed notice of discontinuance at Northampton County Court Business Centre.

 

Im hoping this means end of claim and another victory over Cabot.

Sorry to drag this thread up again, but im a little concerned and i don't really know if i need to be.

 

Just checked the MCOL website expecting to see the claim status as discontinued, however this is not the case. It currently reads,

 

A bar has been put in place on this claim. You cannot respond to the claim at this time.

 

Can someone please explain in layman's terms what this actually means.

I can log in no problem and all the details of the claim are there, it's just that as of the 10th Sept the claim was supposedly discontinued and i expected the claim status to show this, however it doesn't, it shows, A bar has been put in place on this claim. You cannot respond to the claim at this time. I was concerned as to exactly what this means.

Discontinuances do not show on MCOL...MCOL ends once a defence has been submitted

Now im worried. Because we received the letter telling us they were discontinuing the claim, we never submitted a defence, assuming we didn't have to because there was now no case to answer. Are you saying that we should still have submitted a defence? or is the claim finished and we can actually forget it?

Check with Northampton as advised...but if the claimant discontinued before your defence due date...then hence the bar both yourself and claimant cant progress it.
