      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

I ,am getting letters from DCA to repay this debt on the letter it,s says i owe the full amount

of £2000 but as i,ve been paying it by D/D until i stopped it the amount is down to £800 but they keep putting the full amount on. is there a letter i can send disputing amount owed ?

What type of debt was this? If it was a loan or credit card you could send MH a CCA request which costs £1 and should also produce a statement of a/c.

 

It would be interesting to see what you get back if Cabot have passed it on to MH (who are the bottom feeders in the industry). ;)

Sorry for the delay have been on nightshift takes a while to get back into the routine again. (1) credit card (2) No PPI( 3) Have asked Cabot in the past about the balance got no reply only response seems it was passed on to MH

And as the debt is in dispute, STOP PAYING THEM!

You'll get answers to questions faster when you hit them in their pocket.

When you send of the CCA, add a line that the debt is in dispute, and why (don't give figures, just say

"the outstanding balance does not tally with my records")

Law firm Shoosmiths has merged with Edinburgh-based Archibald Campbell and Harley in a move intended to expand the debt recovery capabilities of both companies across the UK. The new firm will be known as ACH Shoosmiths in Scotland and will go live in the autumn subject to regulatory approval. Shoosmiths is established across England, while Archibald Campbell and Harley was founded in Edinburgh over 100 years ago. Both firms intend to establish a UK-wide recoveries presence while challenging the market in Scotland as a result of the deal. 30th June 2012.

nothing exciting

 

it was on credit card

 

got into bother trying to repay

 

By the time i got myself sorted debt was sold on to DC

 

just refused to have any dealings with there like this is the first i,ve heard for about 2 yrs i had forgot all about it.

Hi

My wife has a credit card debt approx £800

 

recently she had a letter from some solicitor saying they are starting court proceedings

if she does not contact them to make an offer to pay in the letter

 

they state that they will put an order on to stop selling the house till the debt is cleared.

 

As the house is in joint names

 

it seems i am being blamed as well what I would like to know is can they do this ?

Like I said in the thread

 

its a credit card debt been ongoing for about 3 yrs now then

 

started to get demands from DC

 

now these solicitors making demands.

 

As i,am not on the card I don,t think it,s right that they can stop the house sale if I wanted to sell it.

 

that,s what I was curious about

 

if they really could stop the sale.

 

I,am not putting the house up for sale

 

just wanting to know the legal bits that these solicitors are claiming they can do.

its a letter from a fake/tame dca pretending to be a solicitor.

 

doesn't say will anywhere I bet.

 

is this on your credit file?

 

how old is the card

 

how old is the debt

 

when did you last make a payment?

Hi

Well the solicitors are called shoosmith (that sounds dodgy to start with )

 

It,s on her credit file card taken out in 2007

 

defaulted 2009

 

last payment was Feb 2011

 

she was late or missed payment to some DC

 

and they sent a nasty letter saying no more payments

 

they wanted the full amount( told them what to do with themselves)

 

never heard anything for 2 yrs approx

 

then got the odd demand from different DCs.

 

now this new demand thats about the full picture thanks

have you ever thought of getting all the statements via an sar to the OC?

 

I bet theres heeps of PENALTY charges &/or PPI to reclaim.

Hi again

 

(1) Cabot finance

 

(2) Citi credit card.

 

think Cabot first got in touch 2010.

 

No PPI on it and sorry no idea what SAR/CCA request means :sad:

 

Another letter arrived saying if she will pay off all the debt meaning one off payment

 

they will reduce the amount due did,nt say by how much

go back to post 8 and click the links for

 

SAR to get all the statements from citi

 

and

 

CCA request to make SURe these new people trying to fleece you

hold the correct and enforceable agreement to even demand money from you.

 

I've move you to the citi forum.

 

they'll have a job in getting and enforceable agreement

and the CORRECT T&C's for a citi card

just read in this forum.

 

you also mention they are offering 'a discount'

 

so something is very likely to be wrong somewhere

like PENALTY charges/CCA

 

esp as citi have sold the debt on.

if they could enforce this debt - why sell it with a discount on offer...urm...
