    • Are these the important pages I need to upload ? 1.  pages 1-4 are court form 10a 2.  2 pages of the CCA agreement  3.  Default notice from NewDay, 22/02/20 4.   Lowell letter stating they own debt ,     Dated 16/11/20 5. Unheaded letter also dated 16/11/20 from NewDay saying they assigned “all of the respective rights etc,”  to Lowell on 23/10/20 I make this 9 relevant pages from what I can see   ( all other pages are statements/default notes and lots of FCA info sheets) just needing your confirmation in advance as I don’t want to send over pages that are not required thank you  UCM

    • I spoke to a pro-bono entity this afternoon.  They advise I must initiate a claim in the court v the receiver if I want to then file an application for an order for sale.  I must have a claim/ proceedings to be able to force a sale. The judge in the current proceedings  has told me that I cannot force the lender to sell and the lender cannot interfere either.   If the receiver isn't acting correctly and isn't selling - this means I must make a claim against the receiver I could initiate a claim. Or much quicker  - the other entity - with a charge already - could use that to make an application for an order for sale.
    • Thanks Dave It's not too far away, about 8 or 9 miles, so I will probably venture over on my bike if I can't think of a good reason to drive there again! I'll have a chat with Mrs GB_Joe tomorrow and see which shops they visited, I know M&S was on the list (had to try on multiple sets of trousers!) and they are actually in that bit of retail park. The uniform shop is across the way in the Meridian Centre, so probably not helpful to get them involved.
    • As they have failed to deliver their original PCN you will need to send them an SAR where they should provide that PCN. It should show the address they used . If it is not your current one that would explain the non delivery. If it was correct then perhaps the Post office messed up. A more cynical view would be that UKPC didn't send it so that you couldn't claim the reduction. It appears that UKPC have been there for some time  but I have been unable to find any pictures of their Notices.The leisure park itself is pretty big so while some parts maybe give 5 hours free parking other parts may have restrictions like permits. I haven't been there for years -I went  to Nandos and the bowling centre . I am surprised that they are now infested with UKPC as the place is plenty big enough not to require their dubious services. If you live not to far away it would help if you could get some legible pictures of their signs. Be carful to park in an area that doesn't require a permit and take photos of the entrance signs, the five hour sign and the permit only sign as well as any other signs that are different from the previous signs. Also if their is a payment machine could you please photograph that.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all.Time i got round to starting my own thread.:-)

 

Sent my Subject Action Request to Barclaycard two weeks ago on 16/10/06.

 

As i am claiming for a Barclay current account and a Barclaycard , i sent the request to ;

Barclays Data Protection

Radbroke Hall

Knutsford

Cheshire

WA16 9EU

I know this is the address for Barclay accounts,but they fowarded it internally and i received a confirmation of request letter a few days later dated 18/10/06 along with my statements back to May 04 and the standard "sorry due to microfiche we cannot go back any further "

 

I replied to this on 21/10/06 with a reminder of their obligation to comply with my S.A.R and the arguement of microfiche being a relevant and accessible filing system.

 

Their return letter dated 25/10/06 was much the same as the first,backing their original microfiche arguement and opposing my views.They go on to say they are unable to disclose any further statements under the Data Protetion Act but will let me have copy statements at a charge of £3 each.! :x

 

Question

 

Should i send a complaint ,estimate my remaining charges or wait until the 40 day deadline passes ?

Sent my prelim today for £1,701.28 , £545.72 of that being contractual interest using the goldcard cash advance rate (my card) of 18.9%,which, as a gesture of good will , i reduced to 18%.Sent by registered post.I estimated the charges from July 2001 to May 2004.Dealing with Carl Nuttall. :)

Hi All.Does anyone know how i work out the daily interest on my contractual claim ? I know the formula (claim x 0.00022 )

 

Is this correct only for an 8% interest claim?

 

I am claiming contractual interest at 18% if that helps but i am stuck on this little query before i send my L.B.A.

 

Please help.Read so many posts my eyes have gone square :roll:

Hi there,

 

the formula {claim x 0.00022} is for 8% simple interest.

 

Technically you can't put in a correct daily rate for compounded interest because it increases each day. What you could do is taking your spreadsheet, see how much interest is owing at todays date, then change the date of the spreadsheet to tomorrow's date and the difference will be one day's interest. If you use that figure be aware that over the course of several days you will be claiming less than the spreadsheet is calculating but the difference won't be much and the bank would only have cause for complaint if you were claiming a higher figure, not lower. I hope that makes sense.

 

There is another way of doing it, and that is not to state the daily amount, but to state "compound interest at the same rate up to the date of settlement." You will then provide the total when you are nearing settlement. This is the method I have chosen.

My claim is contractual but not compounded .As far as i'm aware this makes a difference as to how the interest is calculated.Is that right ?

 

I assumed the interest is constant rather than continually increasing ? Therefore calculable ?

As far as I know, contractual interest would be compounded because that is the method used by the banks, and we are applying the same method to our claims. What makes you think the interest you have calculated is simple? If you are right, then to find out the daily rate at 18% you would multiply your total claim (excluding contractual interest) by 0.00049 (18 divided by 100 divided by 365)

The reason i assumed there was a difference between the two was because when i visited vamps chambers,in the simple section, there is option 1...Throughout claim with contractual interest and option 2...Throughout claim with compounded contractual interest.

 

Am i wrong in my interpretation Bong ? If so i am going to have to make changes on my claim .

 

Slightly worried now as i have sent off my letter before action and my calculations may well be wrong !!! Oooooer :|

I wouldn't worry then OP, from the description of the spreadsheets you are doing fine. I don't have experience of Vamps google spreadsheets - so just ignore me. The calculation I gave before still stands though.

Hi All

 

I am now at the court action stage and have a couple of questions i need help with.

 

Barclaycard made me a settlement offer of £200 that i politely refused but assured them i would accept as partial settlement.They replied that this was unacceptable and would not budge from their £200 offer ,then credited my account with £200 anyway.

 

My account limit is £2,250.The £200 they credited brought my balance down to £2,358.

 

With my claim being for £1,701.28 ,am i within my rights to ask for the refunded charges by personal cheque minus enough to bring my account back out of the red ? or do they have the right to knock the entire amount off my balance ?

 

I would like to think that as it is my money,it would be my choice,once my account is brought back within their terms and conditions,as to how i spend it ?

 

Secondly...with my claim being for contractual interest,is there a tried and tested paragraph to include in my particulars of claim to explain this.I have searched but the results are few and far between regarding contractual rather than compounded contractual interest.

(if you go to the top of the forum tool bar and click on to "Qick Links" then click "Subscribed Threads" this will list all threads you have posted or started, simply right click on the thread you want then click copy shortcut, then go to the thread/reply where you want to place your link right click again and click paste, your link will appear in blue)

 

I'm sure its quite simple but i still don't know how ????
