hi everyone McHall have taken over one of my accounts

I am now on my own with 3 children not working etc so have offered token payment of £1 per month.

in the same letter I also asked them not to call and quoted the paragraph from this group

however they have ignored my offer of £1 and have sent me a letter with three repayment options and have since started calling again

what should I do? I don't want to talk to them and just want to set up a standing order for my £1 until I get myself sorted

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

If you sent the telephone letter get s full complaint to the idiots and tell them they have 14 days to cease calls and confirm in writing they have complied, or you will take legal advice for harassment.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Or better still continue making £1 pm payments to the original creditor (unless the debt has been sold).

If MH are acting as DCA for the OC then the OC is equally responsible for their conduct.

If the calls don't stop, make a formal complaint to MH (and the OC if not sold)

Although it might not stop them, after their final response you can escalate to the FOS which will at least cost them (both if you complain about both) for the investigation

I'm not sure if the debt has been sold,

I haven't actually paid anything to Vanquis (credit card) for around 2 years

it's been passed all around the houses and no one wanted me lonely pound my credit limit was £250

but with charges for going over the ok it and late payment they want over £600 :(

If they are acting on behalf then they cant do anything. Only the owner can, and vanquis are usually very reluctant to do anything themselves unless it is for a huge amount.

How old is the account and have you made a CCA request? Why not make them work for their money. If you haven't already sent a CCA request then send one using the template in the library.

If there are a lot of charges then work out the total of charges and don't pay them (plus the interest charged on them)

If you paid PPI then reclaim it

So they possibly added tons of charges? Time to CCA mucky hall an SAR the OC.

as stated

CCA request to mucky hall + £1PO do not sign the letter

SAR to vanquis, sign the letter and a £10PO.
