Ebay buyer threatening small claims court

Hi im looking for some assistance please. I have an ebay buyer threatening me with the small claims court for an item they say they returned but we havent received.

 

To cut a long story short they were not happy with the item they purchased so we asked them to return it. A few weeks have now passed and we have not received the item back and they cannot provide any proof that they returned the item.

 

Can any one help me where I may stand if they were to take me to the small claims court?

Thats the thing with Ebay, when your returning an item its always in the senders best interest to provide a tracking number or proof of postage.

 

As yours did not & cannot prove they did in fact return the item, I cannot see how they can take you to Small Claims Court.

 

As you need proof, it's as simple as that.

 

Personally, I feel they could be making threats to most likely intimidate yourself into refunding them. (There's a lot of s.cams going on with this particular site, which is why I stopped using it!)

 

So if I was you, I'd send a nice polite message back saying, until you can provide proof that the item was in fact returned then no refund.

 

But be warned they could then open a dispute against yourself, but as long as you have proof you posted it & kept any messages relating to them wanting to return said item, you should be okay. But Ebay & PayPal do at times, make judgements that can go against you.

 

Out of interest how much is the value of this transaction?

 

Have you moved the funds out of your PayPal account? (As I would just in case).

The buyer admitted they have received it, since they complained about not being happy with it. If they didn't send it back via tracked mail, then no refund.

 

eBay tend to go in the buyers favor unfortunately. If they do, make sure to call them and complain about it, they will always give in and give you your money back.

Thanks for the swift reply. The transaction was for just £19.

 

If it is lost in the post the sender can recover their £19 from the Royal Mail.

Would that satisfy them? Offer to provide for them a statement that you haven't received it.

They should have at the very least obtained a free proof of posting..
