MBNA CCJ+CO, Aplins/Hillies, am paying, but they are going for a Warrant?

Hi all,

 

Apologies if this is in the wrong forum, but need some advice on how to proceed.

 

Last year, i had a County Court Order against me from an old MBNA CC,

the court agreed with a payment plan & so do the chasing credit agency,

 

then the beginning of this year, there was a charge placed on on my property in the event of the house been sold,

they would get paid... i understand that etc

 

Now this morning,

i get a letter their solicitors stating that they are about to issue a Warrant of Control,

with the threat of Bailiff's coming round to take good..

even though i had a agreement with them.

 

What are my options??

 

My thoughts are to contact the court, can i have this quashed cause of them chasing me?

So you are making payments in accordance with the court order ?

 

Is there any chance you can scan in this letter - removing any personal information and post it up for us to see ?

 

You will also need to convert your scanned image to pdf format..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I think you really need to establish what this is in respect of ?

 

The only information I can find about this Warrant of control is where payments are not being paid ?

If they want more money, then I think they have to make an application to the court - but not in this manner ?

HI ya, am not sure what you mean by Judgement??..

In terms of payment, they have been receiving payments on time since Nov 2013, as i said before, DLC placed a charge on my property, in case i sell up, which i full understand, but am at a loss on why they would threaten a 'Bailif Visit', unless i have broken the pre-agreed payment plan, by the court...

Ah right...

 

Claimant was Hillesden, done by solicitors Aplins.

Payments are too Hillesden as well

So you ring Aplins tomorrow and state the same...you are adhering to the court order of £xpm and also that the judgment has been executed/ secured by way of a Charging Order already placed and so fail to understand their recent letter.

You do if they actually make application for a Warrant of Control...at this stage they haven't.
