fax the letters to their office, have you made a complaint to the FOS? (They are a joke, no matter what anyone says).

Go and see a Solicitor as well - I have, seeing a Barrister on Friday.

Take the letters to them as well.

Will any solicitor cover this or do I need one that specialises in contacts ?

Only letters sent so far are to their head office . Still waiting a reply that you helped me with on the last letter mate .

u need one that specialises in the Consumer Credit Act.

You probably wont have a productive response from them, they will either ignore or brush over the issues and not give you any resolution.

As for the FOS, they are a bunch of W*nk*rs.

I agree with you totally on that emanevs :D

Just an update , Ive heard nothing back at all apart from the usual few phone calls every few weeks then they stop. No reply to my last letter.

Should I now re-send the letter or start speaking with the FOS ?

Well Still heard nothing and NO reply to my last letter, I get the occassional call from their head office every few weeks which I ignore. BUT today I had a call from Roxburghe saying it was related. I didnt give them any details and I told them to write to me . She said ok and hung up on me.

Anyone heard of them ?? I hear they maybe related to HFO ?? Or is this just another part of welcome / cattles?

i think if its over a certain amount they can, but honestly they will do what ever they like.....

you cant have two mortgages on the same property

a secured loan on the same property is called a second charge

the first being the original mortage

A secured loan is mortgage, same difference.

They are, for all intents and purporses exactly the same thing

i agree but does it not depend on when the agreement was taken out

up to a few years ago, only loans above 25k were classed as a mortgage as they were not regulated by the cca 1974, for which they are now

I think the industry used all sorts of names to try and sell secured borrowing using various terms and definitions that are easier for the public to digest. Home owner loans, secured loans, second charges - call them what you like. People are frightened by the word mortgage as it evokes a long-term financial commitment. Secured loan sounds a great deal easier to digest.

You mention experto dca

any info on the loan etc

Sure loans been indispute for over 15 months and they have defaulted my credit file and update it each month according from the date on the file update even though it just has 1 single default mark.

I have an illegible cca and they change the figures in each letter they send me so no worries there . I'm more worried that after 6 years welcomes updates will continue and after waiting all that time for the default to come off. It will show back up . Hence why I want them to stop processing the data

Can I have a copy of the letter you sent as I wish to do the same thing,

Aslo under the DPA you are entilted to withdraw consent, amd if you can demonstrate in court that the information is inacrute and coursing you damage or distress you can enforce the section 10 notice

Hi All,

i stupidly took out a secured loan with Welcome finance back in 2008. I paid on time every month for 3 years but after i got into financial difficulty I checked my credit agreement and it just didnt add up. the payments and amounts dont tally and i put the account into dispute asking for Welcome to confirm the payments. They dragged it out and sent me 2 or 3 letters since - 1 letter not answering the question , another letter stating I owed a different amount on a different APR from the original CCA and finally they sent me someone elses credit agreement and again on the letter attached had the wrong repayment period and wrong cca. I gave up after this and havent heard from Welcome for the last 2 years.

However i have checked my credit file andeach month they are recording a defauly against me which has caused me reall issues.

Pls can someone advise how I can get this account or the defaults removed ??

I have read various success stories so I know it can be done. Please help

thanks in advance for any advice.

Ok heard nothing from this since last year and now the debt has been sold to mk rapid recoveries.

2 questions on this

1) mkrr are asking for payment. Do u start all over and send them the sar or should I ignore as I went through all this with welcome finance ??

2) now welcome no longer own the debt. Is there any way of getting the charge by welcome on my property removed ??

Thanks

Hi, interesting read this thread I wouldn't worry a great deal yet as im not because from what I can gather MKRR is just a DCA that buys lost causes and possibly even part of welcome, is that confirmed yet?. I have a similiar issue, going to start another thread but subbing here as interested in the answers you seek. :-)

Mine is a secured loan with welcome for 4k but it seems MKDP bought it and now MKRR is chasing.
