Ok,

Another moany post about Harlands and CRS.

So back in April I cancelled my direct debit with Harlands - I had one month to pay.

They sent me a few letters added on a 20.00 admin fee, I called them said considering I paid for 11 months missing 1 month was nothing and asked them to let it go as I had money problems at the time and the gym is crap and over priced. They said they'd let the admin fee off and for me to call back pay the 40.00 I owed for the last month membership and I'd be all done with, I agreed however I then had money problems.

 

 

Anyway they sent 2 more letters, I tried calling countless times but their hold times are ridiculous I work 8-5 and with an hour lunch break I'm not spending it on hold to a bunch of cowboys. Anyway they have now sent it over to CRS they sent me a text and a letter, I called them today as my balance has now jumped from 60.00 to 126.00 I called said this was outrageous, and the extra charge was because CRS is a debt recovery company. I queried this as I said aren't you owned by Harlands they admitted they are and even work in same building but as they are a different department that deal with debt recovery they can add this fee - surely this is crap too? Then I came home today and another letter has been sent saying I need to call in 10 days time or this will escalate and there's mentions of CCJs and going to court..

 

Please help me get these fees down, I don't mind paying the 40.00 originally for the contract of the gym but now jumping to 126.00 I'm 21 I simply cannot afford it.

Hi hannahs. Ive asked the site team to move your thread to the correct forum. Dont worry. Your situation is pretty easy to deal with. Suffice to say you do NOT have to pay their silly admin charges or adhere to their silly timelines.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Hi Hannahs and welcome to CAG

 

You do need to pay off the last month's fee when you can. If you can't afford it in one go, pay it off in 2 or 4 instalments.

 

Write to Harlands and say :-

 

I will pay the final month's fee of £40 due for the month of xxxxx, but I will not pay your unenforceable unlawful penalty charges.

 

Once you agree IN WRITING to accept the £40 in full settlement of all that I owe for the gym membership, I will pay it off in x instalments of £xx each as I am now in Financial Difficulty.

 

My offer stands for 14 days only after which it will be withdrawn. If you fail to accept my offer or you demand any amounts in excess of £40, I will pay you nothing.

Thank you :)Ok I've written the letter and will send off today. I'm scared though about this CCJ they have threatened me with. Can they actually do anything?

Afaik theyve never done court. They dobt want the authorities to see their unlawful charges.

Hi Hannahs,

 

I've been dealing with gym cases here for the last 5 years or so. In that time, I've seen less than 5 cases go to court, despite seeing thousands of folk threatened with court action.

 

The gyms or their admin companies threaten court all the time but, in 99.9% of cases, they stay away from courts entirely.

One other point ...........

 

Many folk are scared gym disputes will end up spoiling their credit rating. This is not true as gym memberships are no longer reported by the CRA's, nor have they been since probably 2010.
