    • Clyde Valley Housing Association have received the following reprimand because of an infringement that occurred in July 2022 when they released a new customer portal. This portal included personal data of data subjects and residents found they were able to view personal information such as names and addresses about other residents. A resident reported this to Clyde Valley Housing Association, however this concern was not escalated appropriately which led to data remaining viewable on the portal for a further 5 days until further residents reported the issue and Clyde Valley Housing Association suspended the portal.View the full article
    • It's mostly small investors, isn't it, TJ? I don't think Wall Street and institutions have bought into Truth Social. Much like US banks don't want to lend to him, I'm reading.
    • Looking on their website I would of thought that a Life interest trust would of been set up, and they state:   "A life interest trust  (also known as possession trusts or interest in possession trusts) be used for preserving assets for the next generation whilst providing a benefit for the current generation. For example, if your home is placed into a life interest trust, then the person with this interest can continue to live there until their death. The house would then be distributed in line with your Will." & A trust can be created in your lifetime, which is to take immediate effect (often referred to as a “lifetime settlement”), or it can be created on death through your Will (known as a “Will Trust”).

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello there.... advice sought please. I have been working for an agency for 14 weeks now on minimum wage, I am aware that after 12 weeks in the same job you should be entitled to the same wage as permanent staff in a comparable position.

So, I emailed my agency contact and this was the reply:

"I was passed an email from you with regards to parity rates when you have worked your 12th week.

Your friend is right to some degree, if a client has a person who works the same job on a fulltime contract with the same job specification then you would be entitled to earn the same wage as the fulltime member of staff.

However with (name removed) this is not the case as we do not have a comparator so as a result there is nobody to match your wage against so you would stay at the same rate of pay I’m afraid."

Fair enough you might say but I'm doing the exact same job as the guy who gets paid a lot more than me to do it!!!

What I'm asking then is, is there anything I can do about it? My fear is that they will suddenly find I am no longer suitable for the job if I make a fuss about it.

I am looking for permanent work but in the meantime I don't want to find myself on the dole for being a "troublemaker", and to be honest I rather like this job. It would just be nice to get a living wage from it.

Thanks in advance and apologies if I have posted in the wrong place xx

"Isn't "x" a comparator?" - if you are sure person X only does the same work as you and nothing else.

I am afraid I can't answer the risk/ reward question here - it's one for you to decide!

Never assume anyone on the internet is who they say they are. Only rely on advice from insured professionals you have paid for!

Can you make some on the quiet enquiries with the comparator direct to see if their job role is indeed the same?

If they are, then you could have a Tribunal claim - but you'd need to be sure before rocking the boat!

Thanks for the replies, the job is in a factory and you get sent to do various roles wherever you are needed under the job title "Production Operative/Packer". The guy I work with does mainly the same job as me but he also does other things that I haven't done, the flip side of that is that I have done some things that he has never done in all the time that he's been there!!! I suppose the fact that the agency staff are moved to where they are needed most within the factory, whereas permanent staff tend to stay in the same section, means that there is no comparator??? Oh well, at least it will look good on my CV if nothing else!!! I can now use a CNC Tapping Machine as well as stick stickers on boxes.... :/

I don't think so izzitime101.... they just have 4 rates of pay for the shop floor workers, the highest being those that are qualified in using certain machinery and the lowest being generally unskilled operatives who do a bit of whatever is needed. My fellow agency workers seem to be stuck on packing which is where I started but I got moved to another section where I am doing semi-skilled work. The permanent staff that I work closest with in the section are on the the second lowest pay rate which is still considerably more than minimum wage!!!!

are you unionised at all?

if so it would be worth joining.

we have a similiar thing where i am,except we have grades, which is very helpful to us.

if no union, i would reccomend speaking to an employment lawyer.

are any other agency staff in the same position as you within the company,as in doing a higher paid job than you get paid for?

if so, have a chat with them, and talk about sharing the cost of speaking to a lawyer.

In the meantime, write down on each payslip which days and hours you have done as overtime, if you get any :)

question everything!
