Having successfully claimed against lloyds

 

i decided too try my luck against MBNA but

 

they refused my application saying PPI was not msisold.

 

They sent me copies of my agreements except my first one which they no longer had copies of.

 

The one agreement shows the tick box for ppi blank so not ticked

therefore not wanted

 

but they state following a phone call several weeks later that i agreed too have it ..

....and on the original one with no paperwork they state that i asked for it.

 

Should i now challange them through the financial ombudsman?

I would suggest that you first send a sar to mbna for all the information held on your accounts, The comms log should reveal

 

how the ppi was sold to you.

 

Best to have all the info before escalating your complaint

Yep I agree with that.

 

Telling people that they bought the insurance in a phone call is a wheeze operated by others too, Capital One being an example.

 

In your SAR, Request a recording of that telephone conversation or a full transcript of it.

 

Isn't it also strange that they know you asked for it on the loan that they cannot provide any paperwork for?

 

They are trying to pull the wool over your eyes.
